SUBJECT: WITHDRAWAL OF NOTICE OF VIOLATIO'l NO. 50 289/97-04 04

Dear Mr. Langenbach:

This letter refers to your July 24,1997 reply to our inspection report No. 50 289/97 04, in
which the NRC cited three Notices of Violation (NOVs) of NRC requirements regarding your
activities in the emergency preparedness (EP) and quality assurance (OA) areas. In your
response to the NOVs you contested violation No. 97 04 04, dealing with the
characterization of findings arising from the OA oversight of EP activities, and you provided
additional information to support your response.
NRC inspectors performed an on site inspection of your emergency preparedness program
during the week of August 4 8,1997, included in their inspection effort was a review of
the response to the NOVs, including NOV No. 97 04 04. The inspectors interviewed
management representatives of your Nuclear Safety Assessment (NSA) staff and obtains d
additional information not available to the NRC at the time of ti,e issuance of NOV 97 04-
04. The existence of NSA procedure 1110 ADM 7216.01, " Management Escalation
Procram for Nuclear Safety Assessment Quality Deficiencies" is one example of the
additional inform 6 tion obtained through those interviews.
Based on the inspectors' review of the information presented in your July 24,1997,
response to the NOV, as well as information obtained during the onsite inspection, we
concluded that the violation of NRC requirements caed in NOV 97 04 04 was based on
incomplete information and, in fact, that no violation occurred. As a result,
NOV 50 289/97-04 04 is being withdrawn.
