Dear Sit / Madam:
By letter dated September 12,1997, from Mr. Ellis W. Merschoff, Regional Administrator of NRC Region IV, the NRC sent me a Notice of Violation (NOV) directing me to submit a written statement or explanation replying to the NOV within 30 days of the date of that letter. I am submitting this letter as my reply to the NOV.
I The NOV concluded that my actions caused my employer, Siemens Power Corporation, to be in violation of certain procedural requirements related to the pi.per handling of materials identified in the NOV. I would like to point out that I've been a conscientious and hardworking employee of Siemens for over 18 years and, except for this one incident, have always complied with applicable nuclear safety procedures and requirements. I also cooperated fully with Siemens and the NRC in their investigation of this incident. As indicated during my interview with the NRC on July 2,1997, I was feeling ill at the time of the incident and was in a hurry to complete my work so I could go home. While I realize that this is no excuse,it did contribute to a momentary lapse of judgment on my part, which was uncharacteristic of me and which will never happen again.
Siemens has already taken a series of corrective actions as a result of this incident to ensure that no further violations will occur in this area. As described in the NRC transmittal letter accompanying the NOV, my disciplinary action included a suspension of f
two weeks without pay, a demotion, additional fitness for duty testing, additional retraining to prevent a recurrence of such an incident, and the submission of a return to O
work letter by me, describing the actions I was going to take to prevent such a j
reoccurrence. The actions which I committed to take in my retum-to-work letter ;nclude strictly adhering to all written procedures and my making " safety first" the focal point of my thought process. I completed cll the activities an i
disciplinary action and retumed to work on May 6,1997, as an incinerator operator with renewed commitment with total compliance with safe operating procedures and practices. 2 With respect to additional corrective actions that will be taken in the future and the date k[!!!((ll!!!!!k!! !

abreast of new developments in this area, voluntarily attend additional training classes on my own time and settle for_ nothing less than 100% compliance with these requirements for the rest of my career in the nuclear industry.
I understand the seriousness of the violation described in the NOV and, as I have indicated in my interview, I will remember this incident and regret the action which I took in connection with this incident for the rest of my life. However, the individual corrective actions associated with my discipline and the company-wide corrective actions related to this incident have caused me and everyone else at Siemens to refocus on the overriding importance of compliance with safety requirements. The incident itself, disciplinary action and everything else that has happened since the incident, have provided me with all the incentive I need to comply with these requirements in the future. I appreciate the second chance I have been given to demonstrate that this was an isolated incident which will never happen again.
I For all the reasons discussed above, I firmly believe that Siemens and the NRC should have confidence in me and my commitment to abide by all regulatory requirements in the future.
l l do not believe that any additional enforcement action is necessary to ensure compliance with these requirements.
