MEETING WITH THE DEPARTMENT OF ENERGY ON NRC'S INVOLVEMENT WITH THE WEST VALLEY DEMONSTRATION PROJECT
' On August 12,1999, staff from NRC's Division of Waste Management met with representatives ,
from DOE headquarters and WVDP offices to discuss criticalissues regarding NRC's
. involvement with the WVDP. DOE identified desired key input from NRC regarding reaching an.
end point for the completion of high-level waste solidification, spent fuel shipment, and performance assessment reviews for the EIS. DOE expressed concerns related to loss of DOE funding support in future years absent certain decision milestones. Therefore, DOE would like to know what the NRC's process will be for evaluating the EIS and a time schedule for review.

DOE also raised some questions regarding the application of the License Termination Rule to
'certain areas of the West Valley site. DOE identified the potential need for further NEPA review of the application of the License Termination Rule to West Valley. DOE stated that they would ,
.like to financially support NRC's West Valley reviews if FTE becomes an issue.
, l NRC requested DOE to prioritize their work items for NRC so that the more important issues can receive prompt and full consideration. NRC stated that the WVDP Act specifies only a j review and consultation role for NRC regarding the WVDP. NRC also stated that review of
- DOE products will be conducted against guidance on the License Termination Rule that applies 3
' to all licensees. This would help alleviate some of NYSERDA's concern that NRC might not l review DOE's analysis and decisions the same way as would be done for a licensee (which i
. NYSERDA will become for this site after DOE completes its mission).- DOE agreed to specify.- !
priorities for NRC 'r eview, to communicate separately with NRC's SFPO on issues of spent fuel p j shipout, and to establish regular communications at a higher levelin DOE and NRC management than currently exists at the project manager level. Other NRC representatives that were present at the August .12,1999, NRC Public meeting included staff from OCM, OGC,
- OCFO, NMSS-SFPO, and NMSS-PMDA. Outside representatives present were from
- NYSERDA and EPA-ORIA. The attendance list is attached.
