PORTSMOUTilINSPECTION REPORT 70 7002/97 206 AND NOTICE OF VIOLATION

Dear Mr. Miller:

This refers to the Nuclear Criticality Safety (NCS) inspection by members of the 11eadquarters stalTecnducted on July 21 to 25,1997, and on August 25 to 29,1997, st your Portsmouth, Ohio facility. The purpose of the inspection was to determine whether activities authorized by your certificate were conducted safely and in accordance with NRC requirements. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the report (Enclosure 1).

Areas examined are identified in the enclosed report. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with plant personnel, and observation of activities in progress. During the inspection, three violations were identified, as described in Enclosure 2, Notice of Violation (Notice).

The first violation involved the failure to flowdown firefighting instructions into emergency packets. The second violation involved the failure to identify the technical basis for the 10 foot spacing between Planned Expeditious llandling equipment in a nuclear criticality safety approval. The third violation involved the failure to establish a Technical Safety Requirement (TSR) for singly contingent operations. These violations are of concern and are being cited because they roll involve the failure to identify and flowdown an adequate criticality safety basis in your facilities. There does not appear to be a positive trend in your perfonnance in this area.

Each of the three violations was identified by the NRC.

In addition to the above, several non cited violations and program weaknesses were noted in the inspection report in the areas of NCS documentation, compliance with administrative controls, maintenance and criticality alarm coverage. These weaknesses were also NRC identified and you should be prepared to demonstrate how they were addressed if they have not already been corrected and discussed in the report.
