, , NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Ground Engineering and Testing Service, Inc. (EA 98-021)

PROPOSED IMPOSITION OF CIVIL PENALTY - $5,500 This is to inform the Commission that e Notice of Violation and Proposed imposition of Civil Penalty in the amount of $5,500 will be issued on or about March 25,1998, to Ground Engineering and Testing Service, Inc., Louisville, Kentucky . The action is based on a Severity Level lli violation involving willful failure of this Agreement State licensee to file for reciprocity before conducting work in NRC jurisdiction.

Because the violation involves careless disregard the staff considered whether corrective action was warranted for both identification and Corrective Action. Credit for identification was not warranted because the violations were identified initially by the State of Kentucky and the NRC. Credit for corrective action was not warranted because, after the violations were identified, the company did not take immediate action to restore compliance, and instead, continued to conduct work in NRC jurisdiction without the proper authorization.

Therefore, a civil penalty in the amount of $5,500 is being proposed.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:

Mailing of Notice March 25,1998 Telephone Notification of Licensee March 25,1998 The State of Kentucky will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
