SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NOS.181 AND 185 TO FACILITY OPERATING LICENSE NOS. DPR 24 AND DPR-27 WISCONSIN ELECTRIC POWER COMPANY POINT BEACH NUCLEAR PLANT. UNIT NOS.1 AND 2 DOCKET NOS. 50-266 AND 50-301

1.0 INTRODUCTION

By letter dated August 14,1997, the Wisconsin Electric Pov.tr Company (the licensee) requested amendments to the Technical Specifications (TS) appended to Facility Operating Licenses Nos. DPR-24 and DPR 27 for the Point Beach Nuclear Plant, Unit Nos.1 and 2.

The proposed amendments would revise TS 15.4.2.B. "In-Service inspection and Testing of Safety Class Components Other than Steam Generator Tubes," to modify item 2 by deleting the reference to TS 15.4.4 and referencing the Containment Leakage Rate Testing Program; TS 15.6.12.A.1," Containment Leakage Rate Testing Program," to eliminate the one-time requirement for Unit 2 Type A testing since the testing has been successfully completed; and TS Bases 15.4.4 to delete the specific bases for containment purge valve testing and correct Reference 5.

2.0 EVALUATION TS 15.4.2.B. "In-Service Inspection and Testing of Safety Class Components Other than Steam Generator Tubes," item 2, states " Containment isolation valves will be tested in accordance with TS 15.4.4 instead of Section IWV-3420, Valve Leak Rate Test." The licensee proposes to change the requirement to " Containment isolation valves will be tested in accordance with the Containment Leakage Rate Testing Program." This change is required since Amendments 169 and 173 to Facility Operating Licenses DPR-24 and DPR-27, respectively, removed the containment leakage rate testing from TG 15.4.4 and added TS 15.6.12," Containment Leakage Rate Testing Program." Since the change eliminates an inconsistency in the TS, the staff finds the change acceptable.

TS 15.6.12.A.1, " Containment Leakage Rate Testing Program," currently states "A program shall be established to implement the leakage rate testing of the containment as required by 10 CFR 50.54(o) and 10 CFR 50, Appendix J, Option B, as modit.ed by approved exemptions. This program shall be in accordance with the guidelines contained in Regulatory Guide 1.163, ' Performance-Based Containment Leak-Test Program,' dated September 1995, 9710060076 970929 PDR ADOCK 05000266 P

2-as modified by the following exceptions: 1. The interval between the 1992 Unit 2 Type A test and the next Unit 2 Type A test shall be 60 months." The licensee proposes to eliminate the exception so that the requirement reads, "A program shall be established to implement =

the leakage rate testing of the containment as required by 10 CFR 50.54(o) and 10 CFR 50, Appendix J, Option B, as modified by approved exemptions. This prngram shall be in accordance with the guidelines contained in Regulatory Guide 1.163, " Performance Based Containment Leak-Test Program, " dated September,1995."

- Amendments 169 and 173 allowed a one-time exception to the 48-month interval endorsed in Regulatory Guide 1.163 in TS 15.0.12.A.1. The one-time extension, of approximately one year, facilitated the planning and execution of the Unit 2 steam generator replacement and facilitated the transition of the containment leakage rate test regime from Appendix J, i

Option A, as previously implemented by the TS, to a leakage rate test program as allowed by Appendix J, Option B. Since the Unit 2 outage extended beyond its originally planned duration, a full pressure Type A test was successfully performed on the Unit 2 containment in early 1997. Therefore, the licensee proposes to eliminate the one-time requirement for Unit 2 Type A testing; Failure to eliminate the requirement would require the licensee to perform another test since the exception requires a specific duration and does not allow early or late performance of the test. Since the exception is no longer required, the staff finds the change acceptable.

containment purge valve testing since TS 15.4.4 no longer contains containment leakage rate testing requirements. The licensee also proposes to delete Reference 5 since it pertains to information previously deleted in Amendments 169 and 173. The staff has no objection to these administrative changes.

3.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Wisconsin State official was notified of the proposed issuance of the amendments. The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

These amendments change a requirement with respect to a change in a surveillance requirement. The staff has determined that the amendments involve no significant increase --

in the amounts, and no significant change in the types, of any effluent that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously published a proposed finding that these amendments involve no significant hazards consideration and there has been no public comment on such finding (62 FR 45466). Accordingly, these amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of these amendments.

5.0 CONCLUSION

1 The Commission has concluded, based on the considerations discussed above, that (1) there

- is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with 1-the Commission's regulations, and (3) tne issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
