h6. Sealed sources containing licensed material shall not be opened or sources removed from
source holders by the licensee. l

l7. A. Sealed sources shall be tested for leakage and/or contamination at intervals not to

exceed the intervals specified in the certificate of registration issued by the NRC l

l under 10 CFR 32.210 or by an Agreement State.

B. In the absence of a certificate from a transferor indicating that a leak test N
has been made within the intervals specified in the certificate of registration
issued by the NRC under 10 CFR 32.210 or by an Agreement State, prior to the l
y
transfer, a sealed source received from another person shall not be put into use
until tested.

C. Sealed sources need not be tested if they are in storage and are not being used. N

However, when they are removed from storage for use or transfer to another person, N

and have not been tested within the required leak test interval, they shall be N
tasted before use or transfer. No sealed source shall be stored for a period of N

Please find enclosed amendment 1 to License No. 50 29058 01. You should review this
license carefully and be sure that you understand all conditions. Please note that as part
of this amendment, the expiration date of your license has been e>. tended by a period of
l five years. Additionally your license has been reformatted to current standards. Your new
expiration date is stated in item 4 of the license. if you have any questions, contact
( Mr. Kent M. Prendergast at 510/975 0255.
NRC expects licensees to conduct their programs with meticulous attention to detail and a ,
high standard of compliance. Because of the serious consequences to employees and the
public which can result from failure to comply with NRC requirements, you mt.st conduct

t + your program involving radioactive materials in accordance with the conditions of your NRC
license, representations made in your license application, and NRC regulations, in
particular, note that you must:
1. Operate in accordance with NRC regulations 10 CFR Part 19, " Notices, instructions
and Reports to Workers: Inspection and investigations," 10 CFR Part 20,
" Standards for Protection Against Radiation," and other applicable regulations.
2. Possess radioactive material only in the quantity and form indicated in your license.
3. Use radioactive material only for the purpose (s) Indicated in your lleense.
4. Notify NRC in writing of any change in mailing address (no fee required if the
location of radioactive material remains the same).
5. Request and obtain written NRC consent before transferring your license or any
right thereunder, either voluntarily or involuntarily, directly or indirectly, through
transfer of control of your license to any person or entity. A transfer of control of
your license includes not only a total change of ownership, but also a change in the
controlling interest in your company whether it is a corporation, ' partnership, or
other entity, in addition, appropriate license amendments must be requested and
obtained for any other planned changes in your facility or prograto that are contrary
to your license or contrary to representations made in your license application, as

well as supplemental correspondence thereto, which are incorporated into your
license. A license fee may be charged for the amendments if you are not in a fee-
exempt category.
6. Maintain in a single document decommissioning records that have been certified for
completeness and accuracy listing all the following items applicable to the license:
* Onsite areas designated or formerly designated as restricted areas as defined

In 10 CFR 20.3(a)(14) or 20.1003.
l l * Onsite areas, other than restricted areas, where radioactive materials in
quantitles greater than amounts listed in Appendix C to 10 CFR
20.1001 20.2401 have been used, poscessed, or stored.
* Onsite areas, other than restricted areas, where spills or other unusual
occurrences involving the spread of contamination in and around the facility,
equipment, or site have occurred that required reporting pursuant to 10 CFR
30.50(b)(1) or (b)(4), including areas where subsequent cleanup procedures
have removed the contamination.
* Specific locations and radionuclide contents of previous and current burial
areas within the site, excluding radioactive material with half lives of 10 days
y or less, depleted uranium used only for shielding or a? penetrators in unused
munitions, or sealed sources authorized for use at temporary job sites.
* Location and description of all contaminated equipment involved in licensed
operations that is to remain onsite after license termination.

7. Submit a complete renewal application with proper fee, or termination request at
least 30 days before the expiration date on your license. You will receive a
reminder notice approximately 90 days before the expiration date. Possession of
radioactive material after your license expires is a violation of NRC regulations.
8. Request termination of your license if you plan to permanently discontinue activities
involving radioactive material.
You will be periodically inspected by NRC. Failure to conduct your program in accordance
with NRC regulations, license conditions, and representations made in your license-
application and supplemental correspondence with NRO will result in enforcement action
against you. This could include issuance of a notice of violation; imposition of a civil

penalty; or an order suspending, modifying, or revoking your license at specified in the
" General Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement

Dear Mr. Prendergast.
Per your telephone question on human occupation near the prospective sourecs.
The most occupied location would be the control room. There is 24 hour occupation at the control
consoles. These consoles are 65 feet ma ny from the nearest source (120 feet from the further source) and
about 45 fret lower (21/2 lhior levels). Also there are at least four permanent walls between them.
Officci, occupied during the regular 40 hour work wock, are from $0 feet to 100 feet away
hortrontally and 40 feet vertically. Bathroems and a lunch room are the nearest areas subject ruatine human
occupation. These are approximately 30 feet away horirontally through a concrete block wall, and 40 feet
(two floors) lower, through concretc and steel flooring.
1he areas immediately (l$'3") below the sources are not expected to be frequented. All routinely
operated devices are powered and controlled from the control consoles, therefose this area is typlea!!y
subject only to penod inspecuens and maintenance (such as the annual feeder gearbox oil change).

Item 1, floor plan indicating location of sources within plaat -
l Please see attachment. The sources are located in Healy Unit Two approximately
15 feet above the fourth floor, between the elevator and the south office stairwell.
Item 2, details on access to gauges: j
There are no platforms, ladders, or ready means of access to the new 100 mci
source locations. They are paced about 15 feet 3 inches above the feeder deck, and over
equipment. Walkways are from approximately 5 feet to 12 feet away horizontally at the
j floor level. The feeder platform will be accessed for brief periods for feeder inspections
by plant operators. During plant overhauls mechanical and electrical crews may work on
the feeders but, in our experience no one has worked in a bunker downspout, as in, in the
beam path, for any reason, ever The downspouts are designed to last the entire life of the
plant therefore access should never be necesmy Even so labels and signs, similar to
those in place by the existing sources, "'ill b. placed to caution people not to work in the
area without locking the shutters closed on the source housings.
Item 3, training:
Training for operations ar.d maintenance staff will be completed by the licensed
Kay-Ray /Sensallinstaller at the time ofinstallation, similarly to the training performed
for the previous source installations. Basic familiarity training (on source locations,
operation and emergency procedures) is completed annually by Golden Valley Electric
Association.
Item 4, emergency procedure update to include manufacturer's phone number.
The emergency procedure already included the mantifacturers name and phone
number (Kay-Ray /Sensall at (708)893-510d), as the existing sources are by the same
manufacturer, and are the same modei housing also.

HCCP is a coal fired power plant featuring new clean coal burning acchnology. HCCP is attached

Amendment to item 6. Addition of Part B:
Part B: Two additional Cesium 137 sources will be used, similarly to the existing gauges, to measure the
level of coal in a pipe. There are two 24" diameter coal feed pipes running from two coal storage silos in
the Healy Clean Coal Project (HCCP). IICCP is a new coal fired power plant built adjacent and attached
to Healy Unit 1, effectively being Healy Unit 2, in a connected structure with several common systems
including coal handling, if a low level is detected by the gauges v!brators are activated on the silo to
break free bridged or stuck coal, thus restoring coal now automatically. See attached drawing D29404
for the complete arrangement.
Amendment to Item 7. Addition of Part B:
Part B: Golden Valley Electric Association (GVEA) will use licensed contractors for such parts of the
leak testing procedure that require use of licensed personnel, GVEA has established a procedure for
swabbing the source housings, for use in conjunction with leak test kit manufacturer's procedures, such
that GVEA personnel will perform the swabbing, under direct supervision of the Radiation Protection
Officer (Paul Morgan), and the swabs will subsequently be examined appropriately in a properly licensed
laboratory. Note that this amendment supersedes the original application in so far as GVEA no longer
wishes to be limited to the use of Kay-Ray /Sensall for leak testing.
Amendment to item 9. Addition of Part B:
Part B: Per the attached drawing number D29404 the general arrangement may be viewed, showing a
-coal silo feeding through a slide valve and reducer to a 24 %" internal diameter downspout. The
downspout feeds a gravimetric coal feeder and eventually drops at a controlled rate into a Foster Wheeler
MBF 21.5 coal pulverizer in order to be ground into fine powder prior to being blown into a boiler for

section of the coal silo. If the coal were to bridge across the silo, or were it stick or freeze to the sides of
the silo, the nuclear coal monitor would detect lesser density and vibrators placed on the silo walls would
automatically be activated to shake off the sides of the silo, or fail any bridging, resuming the coal flow.
The gauges are not directly exposed to excessive vibration, excessive heat (not more than 120 F), or a
corrosive atmosphere, GVEA continues to use a computerized maintenance management program to
initiate work orders to inventory and leak test sources at or exceeding required intervals.
