CALL FROM ENVIROCARE ATTORNEY
!. I just got a cell from Jon Carter, who said he represents Envirocare. He bombarded me with a j whole lot of questions about whether we were following our procedures with regard to the 2206 petition (reading me parts of 2206 and Management Directive 8.11 regarding who initially gets the petition, forwards it to the office director, etc.),whether as "specified in the procedures" OGC was maxing an " initial determination" on the ptition, whather it had been provided to an 4 office director, or where it was now. He also wanted to know when the agency would be
- i. responding to the petition, and whether Envirocare was supposed to be, or could, submit
! anything and when it should be submitted. He opined that in his view the petition was without merit.
i l Of course, I did not give him any specifics, but in response to his quest %ns I told him that OGC
! works WITH the staff, and does not make any independent determinations; that for practical
[ purposes it really isn't important what the procedure is for moving the petition along, but that it
{_ is being considered, that we would respond to it in a reasonable amount of time, and that
, Envirocare was free to submit anything they chose, although to my knowledge they had not i been requested or required to submit anything, and that if they had anything to submit, it
- should be submitted as soon as possible. He asked if they could submit it to me; I told them they were free to do that, and I would so inform the staff if they chose to do that, but that I
- would be out of the office as of next week and they could send it instead to Jack Goldberg.
