SUBJECT: NRC INSPECTION REPORT 50-285/98-02 AND NOTICE OF VIOLATION
Dear Mr. Gambhir:

From February 9-13,1998, an inspection of the quality assurance program was conducted at
your Fort Calhoun Station reactor facility, Following the inspection, an exit meeting was held to

provide the inspection findings to you and other members of your staff. Your staff submitted
additional information on February 13,1998, prior to the exit meeting regarding the inspection
'
findings. Subsequently, in-office inspection was conducted until March 2,1998, and a
supplemental telephonic exit was held with your staff on that date. The enclosed report presents
the scope and results of that inspection.
During this inspection of your quality assurance program, two violations were identified. The fimt
violation was a failure to ensure that a quality assurance lead auditor had completed the
required training as specified in accordance with your quality assurance auditor qualification
manual. The second violation, with two examples, was a failure to initiate a condition report in a
timely manr,er when it was identified that (1) a quality assurance lead auditor had not completed

the required training, and (2) a quality assurance surveillance report had not been issued.

These violations are of concern because of management's failure to ensure programmatic
requirements were fulfilled when these issues were identified.

These violations are cited in the enclosed Notice of Violation (Notice) and the circumstances
surrounding the violations are described in detail in the enclosed report. Please note that you

are required to respond to this letter and should follow the instructions specified in the enclosed
i
Notice when preparing your response. The NRC will use your response, in part, to determine
whether further enforcement action is necessary to ensure ccmpliance with regulatory
requirements.
An observation was made regarding the methodology used for tracking assessment report
i
findings. The methodology was not proceduralized prior to August 1997, and a potential
to fail to track and evaluate assessment report findings existed. This observation is a
concern when considered with a previously identified violation (discussed in NRC Inspection
Report 50-285/97-13) that documented a failure to initiate a condition report for a condition
adverse to quality that was identified in an engineering self assessment. It is our understanding

that during the exit meeting on February 13,1998, you made a commitment to conduct a review
of all assessments performed within 18 months prior to the issuance of Guideline FCSG-4 in
August 1997. This review is to identify any failures to initiate condition reports for assessment-
identified conditions adverse to quality. Please confirm this regulatory commitment in writing
within 30 days of the date of this letter.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its
enclosures, and your response will be placed in the NRC Public Document Room (PDR).
Should you have any questions concerning this inspection, we will be pleased to discuss them
with you.
