i SUPPORTING STATEMENT FOR DOE /NRC FORM 742 " MATERIAL BALANCE REPORT" and NUREG/BR-0007 A. JUSTIFICATION 1. Need for the Information Collection In order for the United States to fulfill its responsibilities as a participant in the US/IAEA Safeguards Agreement and to satisfy bilateral agreements with Australia and Canada and its domestic safe-guards responsibilities, it is necessary for licensees affected by 10 CFR Part 75 and rclated sections of Parts 40, 50, 70, and 150 to submit accounting reports. The accounting reports for each IAEA material balance area must include' material status reports based on a physical inventory of nuclear materials actually present. NRC regulations require each licensee who is authorized to at any one time and location special nuclear material (SNM) possess in a quantity totaling more than 350 grams of contained uranium-235, I uranium-233, or plutonium, or any combination thereof, to prepare and submit reports concerning SNM received, produced, possessed, l transferred, consumed, disposed of, or lost. Each NRC licensee who has been selected for the application of International Atomic Energy Agency (IAEA) safeguards under 10 CFR Part 75 is required to complete and submit Form 742 within thirty days after the start of a physical i inventory. In addition, each licensee, Federal or State, who is authorized to possess, at any one time or location,1,000 kilograms of source material, is required to file with the NRC 3emia ually a statement of source material inventory. 2. Agency Use of Information NRC is required to collect nuclear material transaction information and make it available to tne IAEA. The use of Form 742, together with NUREG/BR-0007, the m;truction for completing the fonn, enables NRC to collect, retriew, analyze as necessary, and submit the data to IAEA to falfill its reporting r?sponsibilities. Use of this report form, in ADO format, enhane.s NRC's ability to collect and provide this data. This informathn is needed to provide to the Australian and Canadian Government.s a periodic report showing the inventory of all materials in each U.S. facility that is subject to their respective Bilateral Agreements; to satisfy the terms of the US/IAEA Safeguards Agreement; and for the domestic inspection program. w-+-,, pe., + [
. l r 3. Reduction of Burden Through Information Technology DOE /NRC Form 742, " Material Balance Report," is used for the collection of this information. NRC and the Department of Energy (DOE) jointly utilize a Nuclear Materials Management and Safeguards System (NMMSS). Cowwn reporting forms are used to minimize the reporting burden on industry members required to provide nuclear material data to one or both agencies in accordance with prevailing regulations or contractual obligations. The licensee is thus able to file one report to meet the requirements of both agencies. Compliance with specific reporting requirements is monitored by the agency for which the specific data is required. 4. Effort to Identify Duplication In general, information regt: ired by HRC in repo ts or records I concerning the transfer, receipt, or change in inventory of source or special nuclear material does not duplicate other Federal information collection requirements and is not.available from any source other than applicants or licensees. Portions of the needed information might also be centained in other information submittals to NRC or other Federal agencies. However, duplication, if any, is slight, and the collection of this information by use of specified forms and other required reports and records is the most effective and least burdensome means of obtaining the information. 5. Effort to Use Similar Information The information collected is not available from any other Federal program. 6. Effort to Reduce Small Bt..;iness Burden g This reporting requirement affects approximately 300 persons licensed by the NRC or an Agreement State to possess source or special nuclear material at certain types of facilities, or at any one time and location in amounts greater than specified amounts. These licensees are large independent industrial fims, each with an I i estimated annual gross income of more than $1 million and a staff of more than 500 people. The NRC ha etermined that the respondents d are not small businesses as that t... is t: sed in the Regulatory Flexibility Act. l 7. Consequences of Less Frequent Collection t Affected licensees are required to submit reports semiannually. This 1 schedule is reasonable because the submission will coincide with the i taking of a physical inventory. The collection and recording of data for inventory purposes is a continuing process that the licensee ca ries out throughout the year for the licensee's internal records.
1 At the specified times for inventory reports, the licensee simply submits the accumulated data from the licensee's records, based either on book inventory or on dat6 from a physical inventory taking, to NRC in the report. The requirement to report within thirty days of the ending date is a reasonable measure ;o ensure timeliness in receipt of inventory data by NRC in order to maintain material accountability under its statutory responsibility pursuant to the Atomic Energy Act to assure protection of the common defense and security. Moreover, the US/IAEA Safeguards Agreement specifies that reports are to be submitteo within 30 days following a physical inventury taking. The Canadian end Australian Bilateral Agreements require that reports be submitted yearly and twice yearly, respectively. 8. Circumstances which Justify Variation From OMB Guidance Contrary to 0F3 guidelines in 5 CFR 1320.6, Section 75.35 reqeires submission of the report within 30, days or less. This requirement is necessary to satisfy the terms of the US/IAEA Safeguards Agreement (INFCIRC/288). 9. Consultation Outside of the NRC 4 The NRC staff has met and consulted with a group of typical licensees concerning clarification of instructions for reporting data and the burden of such reporting. Meetings were held August 7-10, 1990.
- 10. Confidentiality of Information Some proprietary information may be included when necessary to provide adequate response.
An application to withhold such information from public disclosure may be made, and would be disposed of, in accordance with the provisions of 10 CFR 2.790. If any of this information is of particular sensitivity, a request may be made that such information not be physically transmitted to the IAEA; such a request must refer to, and conform sith,10 CFR 74.12. 11. Sensitive Questions. None. 12. Estimated Annualized Cost to the Federal Government The collection of information requiras an average of 5 min./ form of NRC staff time. For approximately 600 reports the collection requires 50 hours per year (5 min./ report x 600 reports = 50 hrs /yr). Annual labor costs at $92 per staff hour will be $4600.

E_stimated Cost to Respond The annual cost to each respondent to comply with this require- - ment is estimated to be $184,i The total annual cost to all affected licensees is estimated to be $55,200. a c. Source of Burden Dhta and Method of Estimating Burden This data is based on informal consultations by the staff with a small number of typical licensees and on enalysis of actual i submissions to NRC. Cost estimates are based on a rate of $92 j per hour.

- NRC and DOE share the-cost of operating the Nuclear Materials Management and Safeguards System-(MHSS). Current and projected cost of the system is:
FY 9Q $1.1 million. This includes the cost of ADP, record holding, and clerical processin of all forms (00E/NRC Forms 741, 741 A,: 740M, 742, 742C, and '1AEA ' Form N-71. The cost suballocated to Fona 742 is $21,000.
FUPPORTING STATEMENT FOR DOE /NRC FORM 742C "rtiYSICAL INVENTORY LISTING" Description of the Infomation Collection DOE /NRC Form 742C provides for the collection of a statement of composition of ending inventory of nuclear material semi-annually. A. JUSTIFICATION 1. Need for the Information Collection In order for the United States to, fulfill its responsibilities as a participant in the US/IAEA Safeguards Agreement and it; domestic sateguards responsibilities, it is.necessary for licensees affected by 10 CFR Part 75 and Part 50 to submit a composition of ending inventory. DOE /NRC Form 742C, " Physical Inventory Listing," is used for the collection of this information. In addition, Facility Attachments or Transitional Facility Attachments for those facilities that are subject to 10 CFP Part 75 will specify circumstances under which reports are required and the dates on which they are to be submitted. 2. Agency Use of Information i NRC is required to collect nuclear material inventory information and make it available to the IAEA. The collection and recording of data for inventory purposes is a continuing procen i. hat i.he licensee carries I out throughout the year for the licensee's internal records. At the specified times for inventory reports, the licensee simply submits the accumulated data from the licensee's records, based either on book inventory or on data from a physical inventory taking, to NRC in the report. The requirement to report within thirty days of the ending date is a reasonable measure to ensure timeliness in receipt of inventory data by NRC in order to maintain material accountability under its statutory responsibility pursuant to the Atomic Energy Act j to assure protection of the common defense and security. Moreover, the US/IAEA Safeguards Agreement specifies that reports are to be i submitted within 30 days following a physical inventory taking. The Canadian and Australian Bilateral Agreements require that reports be j submitted yearly and twice yearly, respectively, t 8 Circumstq@s which Justify Variation From OMB Guidance. Contrey to OMB guidelines in 5 CFR 1320.6, Section 75.35 requires submission of the report within 30 days or less. 9. Consultation Outside of the NRC. The staff has met and consulted with a group of typical licensees concerr.ing clarification of. instructions for reporting data and the burden of such reporting. Meetings were held August 7-10, 1990. 10. Confidentiality of Information Proprietary information must be included when necessary to provide adequate respcnse. An application to withhold such information from 3 public disclosure may be made, and would be disposed of, in accordance with the provisions of 10 CFR 2.790. If any of this information is of particular sensitivity, a request may be made that such information not be physically transmitted to the IAEA; such a request must refer to, and must conform with, 10 CFR 74.12. 11. Sensitive Quastions l None. l 12. Estimated Annualized Cost to the Federal Government The collection of information requires an average of 5 min./ form of NRC staff time. For approximately 120 respondents reporting semiannually the collection requires 20 hours per year (5 min./ report x 240 reports / yr. = 20 hrs./yr.). Annual labor costs at 592 per staff hour will be $1840. The other costs-are attributed i to operating the Nuclear Materials Management and Safeguards System (NMMSS).* 13. Estimate of Burden. l a. Estimated Hours Required to Respond to the Information Requirement The burden for preparation and submission of-each report is s i estimated to be eight hours. 120 licensees will each submit two per year, resulting in a total of approximately 240 reports submitted annually. Thus, the total burden for all i licensees will be 1,920 hours.
- NRC and 00E share the cost of operating the Nuclear Materials-Manageinent and Safeguards System (NMMSS). Current cost of the system for NRC for FY 91 is
$1.1 million. This cost is attributable to these nuclear materials *ansaction and accounting report forms. This includes the. cost of-ADP, recors Iding, and clerical processing of all forms (00E/NRC Forms 741, 741A, 740M,-744, 142C, and IAEA Form N-71). The suballocated cost to Form 742C is $22,000.
' 4 b. Estimated Cost to Respond The annual cost to each respondent to comply with this reluire-ment is estimated to be $1,472. The total annual cost to all affected licensees is estimated to be $176,640. c. Source of Burden Data and Method of Estimating Burden This data is based _on informal consultations by the staff with a small number of typical licensees and on analysis of actual submissions to NRC. Cost estimates are based on a rate of $92 per hour. 14. Reasons for Change in Burden In 1986, a revision to the information collection requirement reduced the burden-to 1920 hours. iHowever, in the 1988 renewal submittel to OMB,-the previous burden of 4800 hours was inadvertently not changed.
