NRC NOTICE OF VIOLATION AND INSPECTION REPORT
NO. 50 331/97012(DRP)

Dear Mr. Franz:
On August 21,1997, the NRC completed a routine safety inspection at your Duane Arnold
Energy Center (DAEC) facility. The enclosed report presents the results of that inspection.
During the 6 weet, period covered by this inspection, your conduct of activities at the
DAEC facility was characterized by a safety conscious approach. Work activities were
well controlled and emergent work issues were promptly resolved. We are concerned,
however, about a violation of NRC requirements that was identified by the inspectors
involving two exumples where corrective actions were not implemented in a timely
-manner, in the first instance, an Ernergency Operating Procedure was not corrected for
almost three years following several engineering department recommendations, in the
second instance, engineering personnel identified loose supports on the emergency diesel
.
generator fuel oil piping; however, the supports were not promptly repaired. Additionally,
a final operability determination was not documented as required by your corrective
actions program. This violation is cited in the enclosed Notice of Violation (Notice), and
the circumstances surrounding the violation are described in detailin the enclosed report.
Please note that you are required to respond to this letter and should follow the
instructions specifiod in the enclosed Notice when preparing your response. The NRC will
use your response, in part, to determine whether further enforcement action is necessary
to ensure compliance with regulatory requirements.
