COMBINED LICENSE REVIEW PROCESS This memorandum requests the Commission's approval to seek public comment on the attached draft SECY paper and announce the availability of this paper in the Federa/Reaister. The staff sent an earlier version of the attached paper to the Commission and the industry in April 1993, I
and it briefed the Advisory Committee on Reactor Safeguards (ACRS) on the earlier version in May 1993. After receiving comments from the industry and the ACRS, the staff made substan-tial changes to a subsequent version of the paper dated July 31,1995. The most significant of these changes were: removing a proposed license condition regarding detailed design drawings; removing any mention of hold points in the construction inspection process; and revising the format of the generic combined license. In COMSECY-95-028, dated September 14,1995, the Commission directed the staff to assess the comments on the design certification rulemakings for the evolutionary designs before publishing this paper for additional public comments.
The staff updated the draft SECY paper to reflect current information and made one significant change to the generic combined license. The change was made to the expiration date for the combined license, under advice from the General Counsel, to conform with the Energy Policy Act of 1992. The staff proposes to publish a notice of availability of the attached draft SECY paper in the Federa/Reoisterfor a 120-day comment period and place it in the Public Document Room,10 days after the date of this memorandum.

In the FRN promulgating this paper, the staff should specifically request comments on proposed options for addressing the license expiration date, including the need to revise the AEA to clearly establish the combined license (COL) expiration date at 40 years after the Commission issues its authorization to begin plant operation. In addition, comments should be solicited on revising the AEA to allow for possible open-ended operating licenses, such as those used in other nuclear power countries, where periodic recertifications of plant safety are made.
Regarding the development of an " Operational PRA Rule," the draft paper should be revised to reflect the transfer of rulemaking to NRR under DSI-22. Because I support PRA as a tool to discnminate risk significance of systems, structured and components (SSCs), I recommend that the staff provide more background in the draft SECY paper on the status of this rulemaking, including the rulemaking plan and associated schedule.
In discussing the role of the quality assurance program for a plant being constructed under a COL, the staff should revise the draft SECY paper to reflect the agency's intention to incorporate the risk-informed methods (e.g., graded QA, IST, IS1, and TS changes) that are currently under development. This will enable the licensee and the NRC to focus attention on the more risk-significant SSCs.
Concerning the staffs plan for conducting construction inspections, I understand that a new construction inspection program is in draft form, and its finalization is dependent on improved definition of COL ITAAC and the resolution of outstanding policy issues.
