Subject: NRC Region 1 Inspection Report No. 50 333/90 09

This letter transmits the results of the routine inspection conducted by Messrs. W. Schmidt and

R. Plasse of this office on December 23,1990 through February 14, 1991, at your James A.

FitzPatrick Nuclear Power Plant. Mr. J. Linville, of my staff, attended the exit meeting on

February 14,1991, when Mr. Schmidt discussed the inspection findings with Mr. R. l.iseno and

other members of your staff.

This inspection identified six apparent violations during review of the circumstances surrounding

the inoperability of the technical specification required torus bulk temperature instrumentation.

Further, three apparent violations were identified during review of technical specification

required electrical fire barrier penetration non conformances. These issues are being considered

for escalated enforcement action in accordance with the " General Statement of Policy and

Procedure for NRC Enforcement Action" (Enforcement Policy),10 CFR Part 2. Appendix C.

In both cases there appeared to be failure to follow written procedures, and an inability of site

management, including Quality Assurance, to review for root causes and identify needed

corrective actions. Accordingly, no Notices of Violation are being issued at this time for these

inspection findings. In addition, please be advised that the number and characterization of

apparent violations described in the enclosed inspection report may change as a result of further

NRC review.

We desire to conduct an enforcement conference in the Region 1 office to discuss these apparent

violations with you. The purposes of this conference are to discuss the apparent vie!ations, their

causes and safety significance; to provide you the opportunity to point out any errors in our

inspection report; to provide an opportunity for you to present proposed corrective actions; and

to discuss any information that will help us determine any appropriate enforcement action in

accordance with the Enforcement Policy. You will be advised by separate correspondence of the

results of our deliberations on this matter. No response regarding these apparent violations is

required at this time. We will be in contact with you to establish a mutually agreeable date for

this enforcement conference.
