NRC INSPECTION REPORT NO. 999-90002/99-01 .

Dear Colonel Gehrky:

This refers to the special, unannounced onsite inspection con'd ucted on July 1,1999, at your Fort Knox facility and subsequent reviews of licensing documents and discussions with vendor -

personnel through August 16,1999. The purpose of the inspection was to review the circumstances'and events' surrounding a reported loss of two generally licensed devices (tritium exit signs) which contained licensed material; At the conclusion of the onsite inspection, the j findings were discussed with you.LThe enclosed report presents the results of this inspection.

. Based on the information developed during the inspection, the Nuclear Regulatory Commission i (NRC) has determined that violations of NRC requirements occurred. The violations involved l the failure to maintain records of activities conducted per 10 CFR 31.5(c)(3) and the ' )

unauthorized disposal of two tritium exit signs each containing approximately 9.5 curies.~ The

- circt.mstances surrounding the violations are described in detail in the subject inspection report. l l

You properly reported the event in correspondence dated February 23 and March 23,1999, '

which included your corrective actions.- Additionally, communications with COL Robert Cherry, l representing the Army Program Manager for radiation safety, indicated that corrective actions would include notifications to assure that similar events are prevented at other Army facilities.  ;

The NRC's Interim Enforcement Policy for generally licensed devices containing byproduct material, NUREG-1600, Rev.1, Appendix D, provides that enforcement action normally will not  !

be taken for violations of 10 CFR 31.5 if they are identified by the general licensee, and reported

- to the NRC if reporting is required, provided that the general licensee takes appropriate

' corrective action to address the specific violations and prevent recurrence of similar problems.

7 This Interim Policy was established in conjunction with a rulemaking initiative to provide for periodic contact between the NRC and certain general licensees, and is intended to encourage j '

general licensees to search their facilities to assure that sources are located and to develop ]

appropriate corrective action when deficiencies are found. Therefore, the violations described above are not being cited, and no response to this letter is required. I
