REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR WESTINGHOUSE AP600 DESIGN LETTER OF MAY 1,1997
Dear Mr. McIntyre:
By Westinghouse letter (NSD NRC-97-5103), dated May 1,1997, you submitted material for the closure of leak-before-break open items. You submitted the information via enclosures in both proprietary and non-proprietary form.
In your letter, you identify information which you consider proprietary information and request that it be withheld from public disclosure in accordance with 10 CFR 2.790. The attached affidavit (AW-97-1105), executed by you on May 6,1997, states that the information should be considered exempt from mandatory public disclosure for the following reasons:
(a)
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.
(b)
It consists of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the opplication of which data secures a competitive O
c economic advantage, e.g., by optimization or improved marketability.

You did not provide a definition or meaning for reason (g), as used in your letter to identify certain proprietary information. As such, the staff excluded this undefined reason in the consideration of proprietary information and based the determination of the remaining reason (s). You are requested to review future documents to ensure that either reason (g) is defined in your submittal or that it is not used.
We have reviewed your letter and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercialinformation. Therefore, the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amendad.
Withholding from publicinspection shall not affect the right, if any, of persons properly and directly concemed to inspect the documents. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
