Chairman Jackson requested additional information related to Title VII of the Civil Rights Act of 1964 and Commissioner Dicus commented regarding the realities of budget constraints on the proposed resource request. Commissioner Dia:
approved in part and disapproved in part expressing a view that the criteria which would pennit a deferral to the DOL process are too vague and may be unduly restrictive. Commissioner McGaffigan approved in part and disapproved in part disagreeing wi*.h the change in criteria which related to operation outside the design basis. Subsequently, the comments of the Commission were incorporated into the guidance to staff as reflected in the SRM issued on September 10, 1997.
