.,#o August 13, 1997 The Honorable Dan Schaefer, Chairman Subcommittee on Energy and Power Committee on Commerce J

United States House of Representatives Washington, DC 20515

Dear Mr. Chairman:

The U.S. Nuclear Regulatory Commission (NRC) has sent to the Office of the Federal Register for publication the enclosed Final Policy Statement on Restructuring and Economic Deregulation of the Electric Utility Industry.

This policy statement discusses the NRC's expectations for, and intended approach to, its power reactor licensees as the electric utility industry moves from an environment of rate regulation toward greater competition.

The NRC has concerns about the possible effects that rate deregulation and disaggregation resulting from various restructuring actions involving its power reactor licensees could have on the protection of public health and safety. The final policy statement reflects consideration of public comments received on a draft policy statement that was published in the Federal Register on September 23, 1996.

Sincerely, M

  • r Dennis K. Rathbun, Director Office of Congressional Affairs

August 13, 1997 Mr. Robert P. Murphy General Counsel General Accounting Office Room 7175 441 G. St., NW.

Washington, DC 20548

Dear Mr. Murphy:

Pursuant to Subtitle E of the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 801, the Nuclear Regulatory Commission (NRC) is submitting a final policy statement regarding the NRC's expectations for, and i

intended approach to, its power reactor licensees as the electric utility industry moves from an environment of rate regulation toward greater t

competition, lhe NRC has concerns about the possible effects that rate deregulation and disaggregation resulting from various restructuring actions involving power reactor licensees could have on the protection of public health and safety. This final policy statement sets out policies an,d describes actions that are necessary, based on current regulatory requirements, to ensure that power reactor licensees remain financially qualified to ensure continued safe operation and decommissioning.

We have determined that this action is not a " major rule" as defined in 5 U.S.C. 804(2). We have confirmed this determination with the Office of Management and Budget.

Enclosed is a copy of the final policy statement which is being transmitted to the Federal Register for publication. This final policy statement is scheduled to become effective 60 days after publication in the Federal Register.
