SUBJECT:

NRC INSPECTION REPORT NO. SNM-752/98-001 This refers to the inspection conducted on January 29. 1998, at your West Liberty. West Virginia campus, and to telephone conversations March 3 and 16, 1998.

The purpose of the inspection was to determine the current status of licensed material (an americium 241 alpha source) possessed under your license, and determine the status of a response to a Notice of Violation (Notice) dated August 24. 1995.

The findings were discussed with Dr. H.

Andrew Cook of your staff at the conclusion of the inspection.

The inspection was an examination of activities conducted urider License No.

SNM-752.

License No. SNM-752 also authorized Jossession of a plutonium-beryllium neutron source.

In 1995, through t1e U.S. Department of Energy's (DOE) source retrieval program, the College arranged for the transfer to DOE.

of the plutonium-beryllium neutron source.

The retrieval was accomplished in August 1995, with the source being received by the DOE in Seatember 1995.

The retrieval program did not enable the College to dispose of t1e al)ha calibration source above, which remained with the College in the 3hysics Department. The license ex) ired on February 28, 1995, and the College remained in possession of t1e licensed materials.

In April 1995, the College responded to a telephone request for information with a letter stating the i

source (the plutonium-beryllium) was expected to be transferred in August 1995.

A Notice was sent to West Liberty College on August 24, 1995, because the College still possessed a 1 microcurie americium plated foil alpha radiation source, after the expiration date of the license.

The inspection included a search of areas where the source may have been stored, and determination of the location and physical controls over the source at the present time.

The source was determined to be in the custody of a Professor of Physics, and to have been in storage and not used.

Dr. Cook. Dean of the School of Natural Sciences. Health Sciences and Mathematics, stated, in a telephone call on February 26. 1998, that a response to the Notice had not been written in 1995 because the custodian of the source had not received the Notice.

He stated that a response would be written and submitted before March 26, 1998.

Also. Dr. Cook stated that the College had contacted the West Virginia University Hospitals Campus' Radiation Safety Officer at Morgantown. West Virginia, seeking a method of properly dis)osing of the source.

The transfer was accomplished without incident on March 13.

1998. A response to the Notice of Violation was dated March 14, 1998, giving the information concerning the source disposition.

Within the scope of this inspection. no violation was identified.

After resolution of the issues Dr. Cook stated that application would be made to terminate License No. SNM-752. However, as of April 9. 1998, no termination request had been received.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice." a copy of this letter will be placed in the NRC Public Document Room.
