Dear Mr. Matthews:

I The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review .

I of the preliminary final Remedial Action Plan (RAP) and all associated documentation pertinent to the proposed remedial action for the inactive  ;

uranium mill tailings site at Grand Junction, Colorado. Our review is documented in the enclosed draft Technical Evaluation Report (TER), which discusses the staff's evaluttion of the proposed remedial action for

- compliance with the EPA stardards.

Based on our review, the NRf, staff has identified tpen issues in geotechnical engineering, erosion proter, tion, water resources pt otection, and radon attenuation and site cleasup. These are summarizeo in Table 1.1 of the TER and discussed in detail in the appropriate TER sections. Until these open issues are resolved, NRC is not prepared to-concur in DOE's remedial action plan. After you have had time to review this document, we would be pleased to meet with you to discuss the results of the review and the resolution of these issues. Since we have just received replace'nent copies of the RAP in 3-ring binder format, we expect that changes to resolve the open issues and produce a final RAP wi_11 be accomplished through submittal of page changes.
