Dear Rita:

On August 26 and 27,1997, I accompanied NRC staff on an inspection of the Cintichem site in Tuxedo. Rose Marie Pratt of the Department of Labor was also on site at the time, but she was not able tojoin us for the entire inspection. During the inspection, I obtained some new information regarding the state-regulated radioactive material on site.

You and I have discussed the uranium ore that was possessed by Union Carbide in the late 1950s. Some of that ore has been found in the old Union Carbide landfill on the Cintichem site. NRC and Cintichem both believe that the material is state regulated, and DEC has no information to the contrary. Therefore, since the ore is in the environment, DEC is assertingjurisdiction over the landfill.

When we talked on August 22,1997, I told you that there may be some ore contamination inside Building 3 at Cintichem. At the time, I believed that most of the contamination inside that building originated in the NRC-licensed reactor and therefore was under NRC jurisdiction. I was mistaken. During the recent inspection, Cintichem representatives informed us that virtually all of the radioactive mate.ial found inside Building 3 had the same radionuclide mix as the ore; therefore, it is considered state-regulated radioactive material. They found this material on three floors of Building 3.

Radionuclides that clearly came from the reactor were only found in rock and soil under

Mrs. Rita Aldrich Page 2 Cintichem represcritatives said that they decontaminated the building in accordance with the NRC approved decommissioning plan. NRC had its contractor, l ORISE, perform confirmatory surveys inside the building. ,

Since this radioactive material was inside a building, DEC has nojurisdiction.

Cintichem and the NRC can provide further details of the work they have done there, in the event that the Department of Labor has any regulatory interest in the decommissioning of the building.
