PROPOSED AGREEMENT WITH THE STATE OF OHIO The State of Ohio has submitted a draft request to enter into an Agreement with the Commission under Section 274b of the Atomic Energy Act. The Office of State Programs (OSP) staff has evaluated the request (and supporting documentation) for completeness against the Commission Policy Statement entitled " Criteria for Guidance of States and NRC in Discontinuance of NRC Regulatory Authority and Assumption Thereof by States Through Agreement" (46 FR 7540; January 23,1981), as amended by statements published on July 16, 1981 (46 FR 36969), and on July 21,1983 (48 FR 33376). Based on that review, we have determined that the draft request is ready for technical review and comment by your offices. A copy of the draft request is being provided to your staff. Attached is a proposed schedule for processing the Agreement. In response to a request by the State of Ohio, we seek to complete the processing in time for the A ]reement to be signed b / current Govemor George Voinovich, whose term expires at the end of the year. This schedule was discussed during a meeting with your staff on February 12,1998. During that meeting, staff agreed that to reach the goal of a final Ohio Agreement by December 31,1998, essentially all major milestones must be completed on schedule. At this time, the schedule is theoretically i possible to meet, presuming that no major issue (s) will arise during the review, and that no i extemal event (s) will occur which demand priority attention of the staff, the Commission or the I State. We will closely monitor progress against the schedule and inform you of any changes. We request your office concurrence (e.g., e-mail to RLB2 or memorandum) on the milestones identMed for your office in the proposed schedule. If you are unable to concur with the schedule, we request the identification of revised dates by which you can commit to complete the review milestones. w- , ~(j'y 10 %L,i.< - i

Multiple Addressees 2 FEB 2 7 ss Please note that one in-depth review of the Ohio request should be conducted by NRC offices other than OSP. That complete review should be of the draft request. Comments developed based on the review will be forwarded to Ohio for incorporation into the Governor's formal request to the Chairman. Subsequently, OSP staff plans to review all differences between the draft request and the Governor's formal request, including the State's responses to the NRC comments. Assuming no outstanding issue remains unresolved at that point, OSP will provide you an analysis of the changes and responses to the NRC comments reflected in the Govemor's formal submittal. This will be accompanied by a Commission paper requesting consent to publish the proposed Agreement for public comment. Your office will not be required to review the entire voluminous Ohio request a second time. After your staff agrees that your comments have been satisfactorily resolved, your concurrence on the paper to the Commission will indicate that you agree the Ohio program, if implemented as described, will be adequate to protect public health and safety and will be compatible with NRC's materials program.
