Dear Mr. Pierson:
In the Introduction section of the PGDP and PORTS Compliance Plans, the United States Enrichment Corporation (USEC) committed to provide the Nuclear Regulatory Commission (NRC) with quarterly reports on the implementation status of the Compliance Plans.
The quarterly Compliance Plan Report for the period June 1,1997 through August 31,1997 is enclosed. As required by the Compliance Plan, enclosed is the following information: 1) an executive summary;
- 2) tables listing completed / closed Compliance Plan issues and Compliance Plan issues that are scheduled to be completed during the next quarter; and 3) a detailed listing, sorted by noncompliance, of the individual commitments within each Compliance Plan issue.
In accordance with 10 CFR 76.33(e), and consistent with the NRC's December 18,1995 letter, the infomiation related to Compliance Plan issues A.1 through A.5 for PORTS, and A.1 through A.7 for PGDP is considered to be proprietcry commercial and financial information pursuant to 10 CFR 2.790(d)(1) and 9.17(a)(4) and is exempt from public disclosure. These Compliance Plan issues have been clearly identified as proprietary information.

Description of Compliance Plan Issues and Actions
1 EXECUTIVE SUMMAR Y I.
Introduction On September 15,1995, USEC initially submitted the Compliance Plans for PGDP and PORTS to NRC as part of the Certification Application. Subsequent revisions to the Compliance Plans were submitted to NRC on November 7,1995 (Revision 1), February 5,1996 (Revision 2),
July 12,1996(Revision 3), and August 1,1996(Revision 3 Change A). The Compliance Plans include the following information:
D A description of the areas of noncompliance; A plan of actions and schedule for achieving compliance; and A justification for continued operation with adequate safety and safeguards.
The Compliance Plans contain 106 individual areas of noncompliances or " issues," 57 at PGDP and 49 at PORTS. Each issue includes one or more actions that must be completed in the next several years. There are approximately 450 individual actions contained in the Compliance Plans. Figure I shows graphically the Compliance Plan actions that have been completed and those actions that are remaining to be completed.
The Introduction sections of the Compliance Plans state:
" Subsequent to the Office of Nuclear Material Safety and Safeguards (NMSS) Director's decision on ir.itial certification,USEC will provide quarterly reports to NRC on the impleiaentation status of Compliance Plan commitments. These quarterly status reports will include,w here appropriate, proposed revisions to remove the discussions of noncompliances that have been closed. The reports will also include an executive summary that identifies plans of actions that were completed during the past quarter, plans of actions scheduled to completed / sic] during the next quar'er, and a discussion of any plans of actions that are behind schedule'. The executive summary will be supported by a detailed listing, sorted by noncompliance, of the individual commitments within each plan of action. The listing will include a comparison of the commitment completion date with the current projected completion date for each individual commitment that has not been completed.The first such report will be provided to NRC no later than 90 days after the NMSS Director's decision on initial certification. These reports will be provided until either all plans of action in the PORTS or PGDP Compliance Plan have been completed or the NRC agrees that the reports are no longer necessary."
The initial Compliance Plan report was submitted to NRC on December 18,1996 (reference USEC letter GDP 96-0194). The reporting period for this quarterly report is June 1,1997 through l
August 31,1997.

To address and resolve each issue, the plan of action for that issue must be completed.

Changes to the " Requirements" and " Commitment" sections require NRC l
acknowledgment prior to implementation. This acknowledgment would be in the l
form of a letter response and not an amendment to the Certincate of Compliance.
l The following is a description of Certificate Amendment Requests (CARS) affecting Compliance l Plan issues that were either submitted to NRC or approved by NRC during this reporting period.

On h1 arch 4,1997, USEC submittcd a Certificate Amendment Request (CAR) to, in part, revise Compliance Plan issue A.2, "hteasurement Systems," for PGDP (reference USEC letter GDP 97-0028). This CAR proposed to revise the Plan of Action for this Compliance Plan issue to allow dimensional measurement calculations to determine equipment volumes. This l
CAR was approved by NRC on August 4,1997.
l On April 23,1997, USEC submitted a CAR (reference USEC letter GDP 97-0062) that proposes to revise the Plan of Action and Schedule for PGDP Compliance Plan issue 36,
" Seismic Capability of Buildings C-331 and C-335." This CAR was subsequently revised via l
USEC letter GDP 97-0136 dated July 31,1997. Specifically,this CAR proposes to revise the l
JustificationJbr Continued Operation and the Plan of,1crion and Schedule sections for the l
Compliance Plan issue. The proposed change states that by December 1,1997, USEC shall l
submit for NRC approval an updates seismic risk analysis for PGDP. This CAR is awaiting l
NRC review and approval.
2The term " complete" menns that USEC has fulfilled all of the individual actions described in a Compliance Plan issue. A Compliance Plan issue is considered " closed" when the regulator has reviewed and concurred that all actions have been completed and documented its review in writing.

On July 1,1997, USEC submitted a CAR to revise the Plan for Achieving Compliance with l
NRC Regulations for PORTS Compliance Plan issue 3, Autoclave Upgrades. This revision l
is required to accurately depict the configuration of the Autoclave I,ocking Ring Interlock l
System in the " Commitments" and " Justification for Continued Operation" sections of the l
Compliance Plan. This CAR is currently awaiting NRC review and approval, j
On August i1,1997, USEC submitted a CAR to revise PGDP Compliance Plan issue 3, l
" Autoclave Upgrades," Action item 7. This action requires the modification of the C-360 l
autoclave controls to add a low instrument air pressure switch to initiate containment upon l
loss of instrument air. Ilowever, recent evaluation of this prescribed modification has I
determined that providing a second channel for high pressure containment that does not rely l
on instrument air is an improved alternative.
This CAR proposed to change the I
implementation date for this action item from August 31,1997 to October 31,1997, to l
coincide with completion of another Compliance Plan action item (Issue 3, Action item 4) l which will also require shutting down C-360 operations while the modifications are made.
l This CAR is coently awaiting NRC review and approval.

On July 18,1997, and August 18,1997, USEC submitted CARS for PGDP and PORTS to l
revise issue 2 of the Compliance Plan. This issue requires, in part, that USEC submit an I
update to the application Safety Analysis Report based largely on the DOE site-wide S AR by l
August 17,1997. USEC's etTorts to complete the S AR Update (SARUP) submittal have been l
underway since receipt of the DOE upgraded SAR in mid-February,1997 and a majority of l the necessary activities have been completed, llowever, additional time is required to l
complete the resolution ofinternal comments from plant support groups, to evaluate changes l
to the plant and identified as-found conditions for their impact on SARUP, to review the l
SARUP supporting documents, and to obtain final PORC approval of the proposed I
application changes. Consequently, USEC requested approval of a change in the submittal l
date from August 17,1997 to October 31,1997. These CARS are awaiting NRC review and l
approval.

- 111, Completed Compliance Plan issues This section identities those Compliance Plan issues which USEC has completed as of the cutoff date for this report. Additionally, this section reflects those Compliance Plan issues that have been closed by DOE. There was one Compliance Plan issue closed by NRC during this l
4 reporting period (i.e, PGDP Compliance Plan issue 38,"High Volume Ambient Air Samplers").
l din Table 2 of the last quarterly Compliance Report, USEC indicated that we planned to l
submit a CAR to NRC to change the action required by this issue. This request was submitted to l
NRC on June 26,1997. Ilowever, NRC letter dated August 4,1997 responded that a revision to l
this Compliance Plan issue was not required and subsequently closed this issue.

Of the 106 Compliance Plan issues',6I (i.e.,34 for PGDP and 27 for PORTS) were completed l
as of August 31,1997, and are listed in Table 1. Of the approximate 450 Compliance Plan i
actions,about 330 (i.e.,74 %) were completed as of August 31,1997 (see Figure 1). During this i
reporting period, USEC completed 4 Compliance Plan issues as reDected in Table 1. All l
Compliance Plan issues, and their associated actions, due to be completed by USEC as of August l
31,1997 were completed except for those which a CAR is currently pending NRC review and I
approval as noted in Section 11 of this report.

Compliance Plan issues that are Scheduled to be Completed During the Next Quarter There are 4 Compliance Plan issues coming due between September 1,1997 and November l
30,1997. These issues are listed in Table 2.

Discussion of Any Compliance Plan issues that are Behind Schedule Table 2 identiDes those Compliance Plan issues that have completion dates between September 1,1997 and November 30,1997, but which are currently behind schedule, USEC is l
placing additional emphasis on these issues to complete them within their required due dates.
USEC is required to submit a CAR for NRC review and approval if we cannot complete a Compliance Plan issue within its required due date.
