Dear Chairman Bollwerk and Judges Kline and Lam:
As directed by Paragraph A of the Board's Memorandum and Order of March 9,1998 (Request for Information Regarding Contentions Involving Proprietary and Safeguards Material), Private Fuel Storage L.L.C. (" Applicant") and the State, in consultation with the NRC Staff, are in agreement that Utah Contentions EE and GG, as revised with the subcontentions agreed upon by the State and the Applicant (see Applicant's letter to the Board dated March 2,1998), do not contain any proprietary information and "can be set forth in publicly available Board issuances without violating any applicable confidentiality agreements or the staffs February 12,1998 finding under 10 C.F.R. I 2.790." Specifically, the Applicant has provided Holtec International a l
copy of the revised language of Utah Contention EE, as agreed upon by the Applicant and the State, and has provided Sierra Nuclear Corporation a copy of the revised language of Utah Contention GG, as agreed upon by the Applicant and the State, and has been advised in writing by the two companies, respectively, that Utah Contentions EE and GG, as revised, do not contain proprietary information.
Additionally, the Applicant and the State have compiled a list (attached to this letter) of the proprietary and nonproprietary calculation packages that either has cited as being relevant to the admissibility of Utah Contentions EE and GG. In'accordance with the Board's March 9,1998 Order, the Applicant is hand delivering today to both the Board and the Secretary a copy of the calculation packages identified on the attached list. In addition, the Applicant is providing the NRC Staff with a copy of the proprietary version of the Scooinn Seismic Analyses of HI-STORM on a Western Area ISESI, Holtec Calculation No. HI-961574 (1996), one of the listed 9003200022 980318 PDR ADOCK 07200022 C

- documents being provided today to the Board (and previously provided to the State) since it includes Appendices AA through DD which were not included with the proprietary version filed with the NRC Stafflast summer. The other calculation packages, both proprietary and non-proprietary, are identical to those previously filed with the NRC Staff.
The Applicant has also consulted with the NRC Staffin accordance with Paragraph B of the Board's March 9,1998 Order and has authorized the NRC Staff to represent its agreement that the language of Utah Contentions Security-A through Security-1, as revised (see Applicant's letter to the Board dated March 2,1998), does not contain Safeguards Information such that the contentions can be set forth in publicly available Board issuances without violating any applicable strictures of 10 C.F.R. Part 73 concerning the confidentality of Safeguards Information.
The Applicant has previously provided the Board with electronic versions of all pleadings that it
' has filed relative to the State's late-filed cask-pad seismic stability and physical security plan contentions requested by Paragraph C of the Board's March 9,1998 Order.
