INSPECTION REPORT NO. 50-373/98004(DRP); 50-374/98004(DRP) AND

EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Kingsley:

On March 10,1998, the NRC completed an inspection at your LaSalle facility. The enclosed

report presents the results of that inspection.

During this six-week inspection period, overall performance at the LaSalle Station was

acceptable. The inspectors identified two areas of good performance. During recent adverse

weather, which caused the loss of two of five incoming power lines, plant staff and operators

performed well. Personnel took conservative actions to prepare for a potential complete loss of

offsite power. In addition, audits performed by Quality and Safety Assessment department

personnel during the inspection were thorough with many pertinent issues identified. This

indicated continued improvement in the ability of station personnel to identify problems at LaSalle

Station.

The inspectors also reviewed several aspects of the LaSalle Station Restart Plan and confirmed

related action plans had been implemented. However, we noted the effectiveness of actions in

two of the reviewed areas was not yet sufficient to achieve LaSalle Station's restart goals. In

particular, problems involving personnel performance and corrective action implementation were

exemplified by the occurrences described below, and substantiated by additional examples

documented in your own performance tracking system. We have noted in previous inspections

some improvement in these areas due to implementation of the LaSalle Station Restart Plan.

However, these observations indicate this improvement is not yet self-sustaining. Continued

focus in these areas is warranted.

Based on the results of this inspection, the NRC has determined that violations of NRC

requirements occurred. The first violation included two examples of ineffective corrective actions

for previously identified problems. Specifically, the staff did not address a failure to implement

locked valve checklist verifications, required by the locked valve program, in a timely manner. In

addition, due to personnel error, the staff had not completed timely corrective actions to ensure

completion of required testing of the manual backwash function for the residual heat removal

service water strainers. The second violation, also involving personnel error, occurred when a

change to a plant procedure was not completed as required. Specifically, a corporate Nuclear

Station Work Procedure was implemented at the LaSalle Station without properly addressing an

existing related procedure. These violations are examples of personnel performance and

corrective action problems that existed before the extended shutdown and that your staff is

addressing through the LaSalle County Station Restart Plan. I have been authorized, after

consultation with the Director, Office of Enforcement and the Regional Administrator, to exercise

enforcement discretion in accordance with Section Vll.B.2, " Violations identified During Extended

Shutdowns or Work Stoppages," of the " General Statement of Policy and Procedures for NRC

Enforcement Actions"(Enforcement Policy), and not issue a Notice of Violation in this case.

Specifically, significant NRC enforcement action has already been imposed against LaSalle

Station for the June 1996, service water sealant intrusion event, the violations were related to

problems which were present prior to the events leading to the shutdown, the violations would

not be classified at a severity level higher than Severity Level ll, the violations were not willful,

and enforcement action was not considered necessary to achieve remedial action. In addition,

actions specified in Confirmatory Action Letter Rlll-96-0088 effectively prevent you from

restarting LaSalle County Station without implicit NRC approval.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practices," a copy of this letter and the

enclosure will be placed in the NRC Public Document Room.
