Dear Mr. Sumner:
- By your application dated August 8,1997, you submitted General Electric Company (GE) 1icensing. Topical Report NEDC 32749P, " Extended Power Uprate Safety Analysis Report
- for Edwin 1. Hatch Plant, Units 1 and 2," dated July 1997, and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. In support of your application, GE submitted its affidavit dated August 5,1997, executed by George B. Stramback.
l 1 A nonproprietary version of the subject report was not provided with your application, and we request that a nonproprietary version be submitted to the NRC for release to the NRC.
l Public Document Room within 30 days of receipt of this letter.
GE stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:'

The information discloses a process, method, or apparatus, including supporting without license from General Electric constitutes a competitive ec data and analyses, where prevention.of its use by General Electric's competitors.

mWe have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and,~ on the basis of your statements, have determined that most of the -
submitted information sought to be withheld contains proprietary commercialinformation.
However, some of the information does not fall within the proprietary category.
Therefore, the GE Licensing Topical Report NEDC 32749P marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) Section 103(b) of the
' Atomic Energy Act of 1954, as amended.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information in all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
