RECOMMENDATION TO ISSUE NMSS POLICY AND PROCEDURES LETTER 1-50, " ENVIRONMENTAL JUSTICE IN NEPA DOCUMENTS,"
REVISION 2 I am forwarding the second revision of the Office of Nuclear Material Safety and Safeguards (NMSS) Policy and Procedures Letter 1-50, " Environmental Justice in NEPA Documents." My staff coordinated revisions to the Letter to ensure that NMSS guidance was consistent with the )
final guidance on Environmental Justice issued by the Council on Environmental Quality in l l - December 1997.
I fnrwarded a draft of the revised Letter to the Office of State Programs (OSP)in February 1999. Prior to forwarding the Letter, each NMSS Division had an opportunity to review and l provide comments on the Letter. At that time, the Office of the General Counsel reviewed the Letter and had no legal objections.

! OSP used the draft Letter to support a June 30,1999, Commission paper entitled, " Revised i' Staff Guidance for Considering Environmental Justice Under the National Environmental Policy Act." The Commission subsequently approved issuing the revised Letter on August 5,1999; the Commission's approval did not require changes to the NMSS letter.
To issue the Letter, I have included a memorandum for your signature. Because this Letter could be useful to applicants or licensees preparing material for the NRC's National Environmental Policy Act analyses, the memorandum's distribution includes the Public Document Room.
This memorandum was coordinated through the Environmental Review Task Force.
