Dear Ms. Horbaniuk:

l This is in response to your letter dated August 6,1996, regarding the leak tests frequencies of

)

gauges used under the general license. Please accept my apology for such a delay in responding to you.

i Typically, for gauges used under a general license provision of 10 CFR 31.5 (c) (2), or equivalent Agreement State regulation, are leak tested at intervals of 6 months or as defined on the label.

Regulation 10 CFR 32.51 (b), or equivalent Agreement State regulation, allows for an extension of leak test intervals up to 36 months provided the manufacturer submits sufficient information demonstrating that extending the leak test intervals from 6 to 36 months would not have a significant effect on the probability or consequences of source leakage. The manufacturers, in question, Heuft and Industrial Dynamics, provided this information to the Agreement States of Illinois and California, respectively. The states concluded that the manufacturers had meet the necessary requirements allowing the interval for leak testing to be extended up to 36 months. This included, but not limited too, evaluating gauge construction, primary source containment, prototype i

testing, and operational experience.

We note that Anheuser-Busch, as with other general licensees, may possess fill level gauges with labeling requiring a 6 months leak test interval. Please be advised that as a general licensee, you are required to comply with the leak testing requirements and other requirements indicated on the label for each gauge unless the Agreement State you are located in has given you an exemption.

The user's manual, supplied by the manufacturer, may provide additionalinformation. If you feel that there may be a discrepancy concerning leak testing frequency and that you might require updated labeling, it is suggested that you contact the manufacturer. Only the manufacturer is authorized to modify the labeling on the gauge to clearly restate the current approved leak test interval.
