Maine Yankee Planti You requested that the fourth quarter invoice be adjusted to reflect the l
proration provided in 10 CFR 171.17. You referred to your August 7,1997, letter in which you certified in accordance with 10 CFR 50.82(a)(i) and 50.82(a)(li) that Maine Yankee has l
permanently ceased operations and that fuel has been permanently removed from the reactor as of August 6,1997. Your August 7,1997, letter was docketed by the NRC on August 14, 1997.
The Commission's regulations in 10 CFR 171.17(a) provide that the reactor annual fee will be prorated based on the number of days during the fiscal year the license was in effect before 4
docketing of the certification of permanent cessation of operations and permanent removal of fuel from the reactor vessel. License No. DPR-36 (Docket No. 50-309) was in effect for 317 days in FY 1997 (October 1,1996, through August 13,1997). Based on the FY 1997 power reactor annual fee of $2,978,000, the prorated FY _1997 annual fee for the Maine Yankee Plant is $2,586,403 (317 days @ $8,159/ day). The fourth quarter annual fee bill, invoice No.
AR0367 97, has been amended to reflect the prorated fee, less $2,059,500 (the amount paid for the first three quarters), leaving a balance due of $526,903. The amended invoice is enclosed and a copy was faxed to you on August 29,1997. Interest will be waived if payment is received within 30 days from the invoice date.
