1. The Nuclear Regulatory Commission (the Commission or NRC) has found that:

A. The application for the amendment filed by the Maine Yankee Atomic

' Power Company (the licensee) dated September 13. 1996, as supplemented by letter dated Seatember 25. 1996, complies with the standards and requirements of t1e Atomic Energy Act of 1954. as i

amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter 1:

B. The facility will operate in conformity with the application, the provisions of the Act and the rules and regulations of the Commission:

C. There is reasonable assurance: (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations:

D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.'

2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and 3aragraph 2.B.(6)(b) of the Facility Operating License No. DPR-36 is here)y amended to read as follows:

Technical Soecifications The Technical Specifications contained in Appendix A. as revised through Amendment No. . are hereby incorporated in the license. The licensee shall operate the facility in accordance with the Technical Specifications.

. '9. RECORDS The Plant Operation Review Committee shall maintain written minutes of each meeting and copies shall be provided to the Manager of Operations and Chairman of the Nuclear Safety Audit and Review Committee.

5.5.B. NUCLEAR SAFETY AUDIT AND REVIEW COMMITTEE

1. FUNCTION The Nuclear Safety Audit and Review (NSAR) Committee shall function to provide independent review and audit of all aspects of plant nuclear safety. Adequacy of this review and audit is assured by the cross section of disciplines required of the Committee membershir as described .ii Specification 5.5.B.3. The Committee shall report to the President. Maine Yankee.
2. COMPOSITION The NSAR Committee shall be composed of at least six persons with the Committee membership and its Chairman and Vice Chairman appointed by the President. Maine Yankee. l ,

b. Vice Chairman
c. At least four technically qualified persons who are not members of the plant staff. l
3. QUALIFICATION Membership to the NSAR Committee requires that an individual meet one of the below academic and/or experience requirements:
a. Bachelor Degree or equivalent, plus five (5) years total experience in the below listed disciplines.
b. Nine (9) years total experience in the below listed disciplines. -i (1) Nuclear Power Plant Operations (2) Nuclear Engineering (3) Chemistry and Radiochemistry (4) Mechanical- and Electrical Engineering (5) Radiological Safety (6) Instrumentation and Control (7) Metallurgy (8) Quality Assurance Practices 5.5-4 Amendment No. 24.29.50.77.152.159 9

, 4. ALTERNATES All NSAR Committee alternate members shall be appointed in writing by the President, Maine Yankee to serve on a temporary basis: however, no l more than two alternates shall participate as voting members in NSAR Committee activities at any one time.

5. CONSULTANTS Consultants may be utilized as determined by the NSAR Committee Chairman to provide expert advice, when needed, to the NSAR Committee.
6. MEETING FREQUENCY ,

The NSAR Committee shall meet at least one per six months, plus 25%.

Special meetings may be held when deemed necessary by Company management or by the Chairman of the NSAR Committee, or, in the absence of the Chairman, by tne Vice Chairman.

l 7, OUORUM A quorum of the NSAR shall consist of the Chairman or his designated alternate and at least 4 NSAR members, including alternates, No more than a minority of the quorum shall have line responsibility for operation of the facility.

8. REVIEW RESPONSIBILITIES The NSAR Committee shall review:
a. The Safety Evaluations for (1) changes to equiament or systems and (2) tests or experiments ~ completed under tie provisions of Section 50.59, 10 CFR, to verify that such actions did not constitute an unreviewed safety question.
b. Proposed Changes to procedures, equipment or systems which involve an unreviewed safety question as defined in Section 50.59, 10 CFR.
c. Proposed test or experiment which involve an unreviewed safety question as defined in Section 50.59, 10 CFR.
d. Proposed Changes to Technical Specifications or this Operating 1.icense,
e. Violations of codes, regulations, orders. Technical Specifications, license requirements, or of internal procedures or instructions having nuclear safety significance,
f. Significant operating abnormalities or deviations from normal and expected performance of plant equipment that affect nuclear safety. l 5.5-5 Amendment No. 3d .50.77,159 l

n. Reports and-meeting minutes of the Plant Operation Review Committee. -

1. Perform special reviews and investigations and render reports thereon as requested by the President. Maine Yankee or his l delegated alternate,
j. Significant accidental, unplanned, or uncontrolled radioactive releases including corrective action to prevent recurrence.
9. AUDIT RESPONSIBILITIES.

Audits of facility activities shall be performed under the cognizance of the NSAR Committee.

l These audits shall encompass:

a. The conformance of facility operation to provisions contained within the Technical Specifications and applicable license conditions at least once per 12 months.
b. The performance training and qualification of those members of the facility staff who have a direct relationship to operation, maintenance or technical aspects of the plant, at least once per 12 months,
c. The results of actions taken to correct deficiencies occurring in facility equipment, structures, systems or method of operation that affect nuclear safety at least once per 6 months,
d. The p'erformance of activities required by the Operational ,

Quality Assurance Program to meet the criteria of Appendix "B".

g. The Facility Fire Protection Program and implementing procedures at least once per 24 months.
h. - An independent fire protection and loss prevention ins)ection and audit'shall be performed at-least once per 12 montas utilizing either qualified offsite licensee personnel or an outside fire protection firm.
i. An inspection and audit of the fire protection and loss prevention program shall be_ performed by an outside qualified fire consultant at intervals = no' greater than 3 years.
