M The Unit 3 Significant items List has been updated and needs to be approved by the RAP for attachment to the Commission paper. The updated list will ba distributed to the RAP members by December 9,1996 for review and approval.

W. Travers and E. Imbro have been added as members to the Restart Assessment Panel.

  • The " white paper" for Indian Point 3 contains the inspection elements for the programmatic issue. This will be used by the OSTI for inspection attributes at Millstone.
  • A memorandum will be developed from W. Lanning to P. Mc Kee to initiate negotiations for NRR technical and inspection support.

The initial p3 us for the inspection of Millstone Unit 3 were presented and the conceptual ap.1 roach was approved by the panel (See attachment 1). The panel directed that the j open NRC inspection items be resource loaded to estimate the total inspection resources needed to support the restart of the reactors. The panel also directed that the Significant Items list reflect the Manual Chapter 0350 line items that are satisfied by the individual inspections.

I l The panel considered the need to modify the existing 50.54 (f) letters to M I clarify the information needed prior to restart and when that information would be needed. It was decided that SPO(L) would review the existing letters I and prepare new letters. In particular, these letters will request the licensee to submit their restart punchlist (as determined above). will request the licensee to provide the current deferred items list and a i final deferred items list 60 days before the final readiness for restart of each unit. staff.

The panel agreed that they need to meet on a monthly basis. The March meeting date will be decided at the next Monday morning meeting.

The panel discussed the status of the licensee's program to provide the NRC with complete closure. packages for our inspection items. This was discussed i with the utility at 1he December 17,1996 meeting (see transcript) . To date, the licensee has not been succe7sful in providing completed packages for inspection.

ACTION ITEMS: Senior resident inspectors for Millstone Units 1,2 and 3 resource load the open items list. The task was completed and incorporated into the Significant Items Lists. Issues that are restart issues have been incorporated into the SIL's.

The SP0(L) & SP0(I) will develop a description of what the restart punch list should contain and what should be submitted on the docket.

A draft letter was prepared by SP0(L) for comment. Comments to be provided to J. Andersen not later than Monday.

The SP0(L) will develop a new 10 CFR 50.54(f) letter that will update the needs of the agency regarding what documents should be provided by the licensee to support NRC oversight needs.

J. Andersen provide the draft letter to the panel for review and comment. The panel discussed various approaches and J. Andersen will redraft the letter by March 6 and provide it to the panel for comments by March 10.

  • H. Pastis made a preuntation discussing the progress in the employees concern program. See attached slides.

  • The panel observed that there appears to be significant delays being encountered by the licensee in the development of the design basis for Hillstone Unit 1. The licensee will be asked to discuss this at the next RAP /NU meeting. (Imbro)

Additional Discussion Items:

L. Scholl suggested that the licensee should complete self assessments on the programmatic areas of their programs before the NRC inspects them. The panel agreed that this was a desirable approach, and the question would be posed to the licensee at the next meeting of the RAP /NU. .

The licensed operator training issues should be a line item in the SIL.

The licensee should discuss the " comprehensive" employees concern program plan at the March 18, 1997 meeting.

Action Items:

e J. Andersen to provide an updated 50.54(f) letter for the panels review by March 7. 1997. The panel will review the letter and provide their comments not later than close of business March 10.1997.

(c) Except for continuing inspection of SIL items, most inspection effort in Section C has not been done or even started. Residents need to look at 0350 to determine if any recent inspection effort can cause a Section C item to be signed off.

(5) RAP Decisions (a) SIL items involving licensing matters should refer to licensing issues I listed in Enclosure 5 to the RAP. (See licensing actions below for NRR review of the SIL)

(b) Common items for Units 1,2 and 3 should be linked. Not yet done now but in progress. (Action: L. Scholl)

  • The senior resident inspectors presented a status of the significant items list for each unit.
  • There was a discussion of what actions the licensee was taking to address specific line items in the MC 0350 process. J. Durr will contact the licensee and verify they are developing packages for appropriate line items.

Imbro will identify issues that will be covered by the ICAVP efforts in whole or in part. P.McKee was acsigned the task of making a recommendation to the director concerning sending a letter to the utility expressing our concern for the lateness of filing and the potential to jeopardize our ability to complete them before restart. Agenda items for the next meeting between the NRC and NU should include the following: License amendment status, updates on the "Loftus Model", status of operator licensing corrective actions, status of the 10CFR50.54f responses,

inspections to the end of the ICAVP corrective action inspections will be maintained. J. Trapp will reissue the draft OSTIinspection plan to the RAP for approval. The OSTI schedule will be designed to capture specific activities and to observe operational mode changes whenever they might occur to optimize team efficiency.

MS 3 86 total SIL items; 27 are closed; 37 packages are overdue. MS 2 51 total Sllitems; 10 are closed MS 1 108 total SIL items; 1 is closed. The panel agreed that it was acceptable to close a SIL item during the inspection of the item if one or more unresolved issues remained that did not impact the restart criteria for the unit. For example,if the SIL item was a programmatic area and the inspection identified a minor administrative unresolved issue, it is appropriate to close the Sll and track the issue under the open item tracking system. The MC 40500 team leader presented his observations that supported the inspection starting on the proposed date. The panel agreed to starting the inspection on February 9,1998.

The resident inspection staff provided an update of the Significant Items List status. Unit 2: Twelve of the 52 SIL packages have been closed; 30 items are in the licensees process. All NRC backlog packages are being inspected. Unit 3: Thirty eight of the 86 SIL packages are closed as of December. Five of the SIL's will not have packages because they are programmatic issues such as review the Hannon Report or review the enforcement j issues. NNECO owes us 13 SIL packages. Of the remaining 30 packages,9 r,equire inputs from NRR; 14 will be inspected by special  ; inspection teams and 7 are within SPO control. l E. Imbro provided a status report on the progress of the ICAVP effort. The NRC has completed tier 2 and 3 for Unit 3. There will be a public exit on 1/28/98. Tier 1 will be onsite for 2 weeks and exit on 2/6/98. The corrective action inspection is scheduled to begin the week of 2/1/98 and end on 3/27/98. It will be 2 weeks onsite, a week off site, and 2 more weeks onsite. It will examine NNECO's corrective actions for deficiency reports. A. Cerne will provide the ICAVP team with selected open items for inspection. P. Mckee discussed the inspection processes that will examine the interface for issues that need to be included in the FSAR. It was decided that the MC 40500 inspection team would examine the FSAR change process. I W.

I 6 . e 3 The project managers provided a status report on license amendment requests for Units 2 and 3. For Unit 3, there are 6 open LAR's,4 for mode 4 and 2 are near completioii. The instrument inaccuracies needs more information and may challenge the mode change dates. The LAR dealing with the pressurizer level setpoint may need to be revised, there is currently a request for information. Two LAR's are needed for mode 2, the issue on the spent fuel pool boraflex and the shutdown margin monitor.
