Dear Mr. Ravenscroft:

This refers to the inspection of the Physical Protection of a Shipment of Irradiated Fuel conducted by William Tobin on January 26, 1998, and to the i telephonic discussion between you and Douglas Collins Director Division of  ;

Nuclear Materials Safety on February 2,1998. 3 I

The areas examined during the inspection were the security measures afforded the Department of Energy's shipment of foreign research reactor spent fuel with port of entry at the Charleston Naval Wea)ons Station in Charleston, South Carolina, and terminating at the Savanna, River Site (SRS) in Aiken, South Carolina. The inspection consisted of selective examinations of procedures and representative records, interview with personnel, and i observation by the inspector. j Within the scope of the inspection, violations or deviations were not identified. However, as we discussed, we are cr 'rned that the railcar shipment, which arrived at the SRS at ap3roximm si.y 6:30 p.m., on January 26.

We recognize that the security of the shipment had been turned over to the Department of Energy (DOE) at this point and that, during this delay, armed DOE officers provided security for the shipment. We also understand that unantici)ated railway delays resulted in the expiration of the engineer's scheduled worc shift and thus the stoppage of the train at l 7:00 p.m. January 26, while on DOE property.

As we discussed during our February 2 telephone call, NRC regulations in 10 CFR Part 73.37(b)(8) require shiaments to be planned so that scheduled l

intermediate stops are avoided to t1e extent practicable. We believe that .

you, as the licensee, and your ship)ing agent should have anticipated the need )

for a relief crew to complete the slipment. During our February 2 telephone i discussion you furnished the following " lessons learned" measures which you i plan for further rail shipments:

l e You plan to establish a formal timetable arrangement with your shipper I to cause the activation of a relief crew so that work shift changes  !

real-time L'.atus of the shipment and ensure the timetable arrangement is being met, e Your contingency procedure will be enhanced to address such issues as j the availability of relief crews, terminating work shifts, and stoppages outside the DOE secured area.

We will inspect the effectiveness of these changes during future inspections.

In accordance with 10 CFR 2. 30 of the NRC's " Rules of Practice," a copy of this letter and its enclosure will be placed in the NRC Public' Document Room.
