ALLEGED DISCRIMINATION

Dear Mr. Langenbach:

1 On May 12,1997, the U.S. Department of Labor, Occupational Safety and Health  !

Administration in Philadelphia received a complaint from an employee of GPU Nuclear, Inc.

The employee alleged that he was the subject of acts of discrimination (poor performance appraisal, reassignment of job responsibilities, and a hostile / punitive work environment) for bringing safety concerns to licensee management and the NRC regarding maintenance of an acceptable level of err.ergency preparedness at TMI, including ability to perform dose assessment, classify an event, and arrive at proper protective action recommendations. In response to that compla!at, the Occupational Safety and Health Administration notified you in a letter dated June 16,1997, that a settlement agreement had been approved and compliance with the terms of the agreement would cause the matter to be closed.

While we recognize that GPU Nuclear, Inc. appears to have settled its differences with this individual, sine:e the individual was engaged in protected activity, you should take whatever actions are needed to ensure this rnatter does not have a chilling effect on other licunsee or contractor personnel in deterring them from identifying any nuclear safety-related concerns they may have.

In accordance with 10 CFR 2.700 of the NRC's " Rules of Practice," a copy of this letter and your response will be placed in the NRC Public Document Room.
