The Staff has received the " State of New York and Suffolk County l

Proposed Schedule Regarding KLD TR-201 A" for discovery and filing of l-rebuttal testimony in regard to KLD TR-201 A, which was ordered by the j

Board in its June 12, 1987 Memorandum and Order (Ruling on LILCO's Motion I

to Substitute Written Testimony).

The Staff has no objection to the proposed I

discovery schedule set forth therein.

However, the Staff does object to the State's proposed date for filing j

l l

testimony on July 22, only one day before the State's witnesses are scheduled to testify on this issue.

As the Staff noted in its May 21, 1987 response to LILCO's motion to substitute KLD TR-201A, that analysis adds limited data L

and refines the time estimates contained in KLD TR-201.

KLD TR-201 A is not l

substantively different from KLD TR-201.

Consequently, the Staff proposes

.that the testimony of the State witnesses be filed not later than July 6,1987, which will give the parties time to properly prepare for cross examination on the additional testimony of the New York State witnesses.
