March 10,1998 STATE OF UTAH'S MOTION FOR EXTENSION OF TIME l

TO FILE CORRECTIONS TO THE REVISED TRANSCRIPT.

L The State of Utah hereby requests a week's extension of the Board's March 13,1998, deadline for filing corrections to the revised transcript of the January 27-29,1998 prehearing conference. Consideration of this motion is requested because the State still has not received the revised transcript. In the Board's Order of March 5,1998, the Board, having received its i

revised transcript on March 4,1998, understood "that copies have been provided to all participants who requested transcripts from the coun reporter service."

In today's communication with Ann Riley & Associates, LTD, the court reponers for the prehearing conference, the State was informed that revised transcripts will be sent out today for delivery tomorrow morning. The State was further informed that Ann Riley &

Associates, while having informed the Board that copies would be provided to requesting panies, was no: aware that the Board would provide parties an opportunity to review the revised transcript with a deadline by which to propose corrections, and had not considered the provision of these copies to requesting panies es urgent. Once the court reporter understood 1

the deadline for filing proposed corrections, it advised us that a copy of the revised transcript h9) 9903160249 980310 PDR ADOCK 07200022 C

PDR

would be delivered to Diane Curran, our counsel in Washington, D.C., today.

Nevenheless, after the State receives the revised transcript, copies must be provided to the rest of the State's attorneys who participated in the prehearing conference; this will i

require extra time.

)

As required by the Board's September 23,1997, Order, the State has contacted or attempted to contact other parties to the proceeding regarding this motion. The Nuclear -

Regulatory Commission Staff does not object to a week's extension, if the deadline for

)

objections to proposed transcript corrections be extended accordingly. Confederated Tribes of the Goshute Reservation and David Pete, Ohngo Gaudadeh Devia, and Scientists for Secure Waste Storage have no objections. The State left messages for Petitioners Castle Rock Land and Livestock, L.C., et al, and for the Applicant and the Skull Valley Band of Goshute -

Indians, but as of the time of Cling this Motion, has not received a response.

i 1

For the foregoing reasons, the State respectfully requests the Board to grant an extension of one week, or until March 20,1998, to file proposed corrections to the revised transcript. In addition, the State requests the Board to reschedule the deadline for filing objections to any proposed transcript corrections accordingly.

DATED this 10th day of March,1998.

Respectfully submitted,

&0
