RESPONSE TO YOUR MARCH 16,1998 LETTER TO NRC CHAIRMAN JACKSON
Dear Mr. Shadis:
I am responding to your March 16,1998 letter to Chairman Jackson conceming the Maine l
Yankee Atomic Power Station and the statements of Mr. Patrick Dostie, State Nuclear Safety l
Inspector conceming the potential shipment and offsite disposal of low-level radioactive material at a local landfill. As you indicated, these statements were made at a public Citizen's Advisory l
l Panel (CAP) meeting on March 5,1998. The NRC Senior Resident Inspector assigned to the Maine Yankee facility was in attendance.
We believe that the NRC's actions to evaluate this issue have been prudent and timely. The Senior Resident inspector took prompt and appropriate actions by contacting NRC management in Region I (King of Prussia, PA) early the next day (prior to 8:00 a.m.). Regional management u
discussed the issue with senior Maine Yankee officials later that morning. We believe that the -
proper NRC action at this time is to allow Maine Yankee to do a complete, thorough, and timely t
evaluation of the issue, as they have committed to do. Our basis for proceeding in this manner 1
is: 1) the potential concentration and amount of radioactive material released off-site is very low-l level; (2) this low-level of radioactive material would cause minimal impact, if any, on the public health and safety; (3) the landfill in question has been closed and capped for approximately six years.
l In addition, concurrent with the Maine Yankee investigation, water samples from the landfill and l
an adjacent well were collected, and split samples are being independently analyzed by the State of Maine, the NRC, and the licensee. Finally, the NRC is conducting a' review to l
determine what information concerning the release of material from the site may have been l
documented in the inspection record.
' Once the Maine Yankee review is complete, we will review the licensee's response as well as the analytical data from the water samples and any other information available to us to determine if additional NRC action is appropriate.

Friends of the Coast As you have heard stated at public meetings held in Wiscasset, Maine in the Fall of 1997, NRC will continue to oversee the decommissioning activities at Maine Yankee as warranted to ensure that the decommissioning activities are accomplished in accordance with Maine Yankee commitments and NRC regulatory requirements and that the public health and safety is protected. We will continue to include the Friends of the Coast on distribution for our inspection reports and other NRC documents concerning the Maine Yankee Atomic Power Station.
