I approve of the rulemaking that clarifies and makes consistent the physical protection l
requirements for independent storage of spent nuclear fuel including the performance-based capabilities provided in 73.51(b)(2) of the proposed rule.
I am concerned that the prescriptive language of 73.51(d) obviates the performance-j based language of 73.51(b)(2), and would require a number of exemptions for site-q specific ISFSI licensees. Therefore, the staff should either:
)
(1) delete the requirements of 73.51(d), stating in the Statements of Consideration for i
the rule that the Standard Review Plan (NUREG-1619) contains an acceptable approach; or, (2) add language to the rule (similar to that provided in 10 CFR 61.58),-
which provides for the staff to accept an alternative approach to the physical protection l
requirements.
