SECY-86-276 - Review of ALAB-840 (In~the Matter of Philadelphia Electric Company)
,The Commission approved an order detailing the Commission's decision on-the review of ALAB-840 and a motion by Robert Anthony / Friends' of the Earth to disqualify counsel for licensee and to reopen the record of the-Limerick proceeding on offsite emergency planning.
Chairman Zech and Commissioners Roberts, Bernthal, and Carr approved the portion of the order which ruled that the Appeal-Board did not have jurisdiction and therefore vacated ALAB-840.
Commissioner Asselstine disapproved the portion of the order dealing with the jurisdiction question and provided separate views.:In addition, Chairman Zech and Commissioners Roberts, Asselstine, and Bernthal_ approved the denial of-motions to disquality counsel and reopen the record.
Commissioner Carr abstained from the decision on-the merits of Mr. Anthony's-motion since he was not a commissioner at the time that ALAB-836 was befora the Commission for review.
(Subsequently, on October 16, 1986 the Secretary signed the Order.)
