7 DCS May 7, 1987 EN 87-39 0FFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Comonwealth (Dresden, Units Edison 1, 2, and Company) 3 Docket Nos. 50-10, 50-237, and 50-249

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about May 12, 1987 to Comonwealth Edison Company. This action is based on a violation involving the failure to ensure the integrity of the protected area barrier. The licensee had several opportunities to identify the problem. Therefore, any mitigation that the licensee may have received for corrective actions and prior enforcement history is offset by the duration of the violation, prior notice of similar problems provided by an IE Information Notice, and opportunities to discover the violation through licensee conducted audits.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Deputy Executive Director for Regional Operations to sign this action. The schedule of issuance and notification is:

Mailing of Notice May 12, 1987 Telephone Notification of Licensee May 12, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Illinois will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
