Dear Congressman Gunderson:
This will reply to your letter of April 16, 1987 in which you forwarded Ms. Anderson's letter to you on the subject of the Seabrook Nuclear Power Plant and requested an update on the situation at Seabrook.
I cannot respond to Ms. Anderson's consents because the matter of the Seabrook license's being considered in an on-the-record adjudicatory proceeding. Any decisions in that matter will be made on the basis of the ~
record and will be issued on the record. You can be assured, however, that I
the matter is receiving the Comission's serious consideration.
The litigation of this case is extremely complicated with issues currently before two Atomic Safety and Licensing Boards, as well as the Atomic Safety and Licensing Appeal Board and the Cor. mission itself.
Two recent decisions have been of particular interest:
(1) the Comission's decision not to pemit a low-power license to issue in this case absent any emergency plan i
for that portion of the plume exposure emergency zone (EPZ) that lies in Massachusetts and (2) the decision of the Atomic Safety and Licensing Board that the Applicant's request for a waiver of the Comission's emergency planning rule on the size of the EPZ was insufficient.
Pending before the Comission is-the Applicant's motion to lift its stay of issuance.of a low-power license based on the Applicant's having submitted its emergency plan for the portion of Massachusetts that lies in the EPZ. Also pending before the Appeal Board are motions to stay issuance of a low-power license founded on various other legal and factual bases. Decisions on these matters may be expected over the course of the next month or so.
