.-.m mr NOTICE OF VIOLATION Inverness Mining Company License No. 12-15569-01 Minerva Mines and General License As a result of the inspection conducted on April 9, 1987, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violations were identified:

License Condition 18 requires that all licensed material be possessed and used in accordance with statements, representations and procedures contained in letter dated April 13, 1984.
Letter dated April 13, 1984, names an individual as the Radiation Protection Officer.
Contrary to the above, an individual not named as the Radiation Protection Officer (R.P.O.) has assumed the duties of the R.P.O.
The individual named as R.P.O. left the company in 1984, and a person not authorized by the license has assumed the duties of the R.P.O.
This is a Severity Level IV violation (Supplement VI).

10 CFR 3.15(c)(2) states that each person who hcs a gauge authorized by a general license shall test the radioactive source for leakage and test the on-off mechanism for proper operation at the period specified on the label.
Contrary to the above, the radioactive source was not tested for leakage i
and the on-off mechanism was not tested for proper operation at the period specified on the label. The Kay Ray Model 7062BP gauge should be tested for leakage and the on-off mechanism tested for proper operation every i
three years. These tests have not been performed since December 1981.
This is a Severity Level IV violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement l
or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
