I J. Anderson opened the meeting indicating concern with the implications l from the March 23, 1987 letter from Chairman Zech to Senator Simpson {

(WY). Of special concern to DOE was the prospect of bearing all the l liabilities and responsibilities for the remedial action without the control over its performance.

The land disposal question was seen to be a legal technicality requiring State acquisition prior to commencing remedial action. Recent activities by the Bureau of Land Management were discussed, including the decision to go forward with purchase requests by the bidding licensees in the Gas Hills. (Most of the lands for disposal are BLM-owned).  !

i R. Marquez proposed that NRC and DOE re-examine their positions to see whether a legal interpretation coald not be made which could be similar l

to that of the Edgemont, SD vicinity properties (Vicinity property material under Title I of UMTRCA is being disposed of at a Title II licensed site with no further continued DOE responsibility). It was agreed to tentatively schedule a meeting in Washington, D.C. on June 10, 1987, involving legal and program staffs of NRC, DOE and the State of l Wyoming. l 8706250220 870611  ;

-2 Marquez also indicated that the long-term (LT) surveillance and monitoring could be handled by the active (Title II) licensee until the-time for license termination and land transfer to 00E. This would be a concern if the licensee were not to complete the total reclamation by the termination date of UMTRAP.

The schedule presented by DOE, which was established in response to pressure from the State of Wyoming, was seen by NRC participants as being extremely ambitious and too dependent on NRC's approval of' license l amendments (andreclamationplanrevisions).inaveryshorttimeinterval i (15 calendar days). This was seen to be even more of a concern since one-bidder has had planning documents submitted to NRC and DOE for more than a year.- This might be seen as unfair advantage to other potential bidders.

The surety question is complicated by the fact that the revised reclamation plans need to be thoroughly reviewed to determine whether or not the surety is adequate. DOE indicated that the bidders will need to get a performance bond separate from the surety determined by NRC as required from the license to assure proper reclamation.

Discussion moved to how 00E would handle awarding the contract. Various permutations were considered, but the-tentative opinion of the participants was that all bidders would need to have NRC-approved licer a amendments and revised reclamation plans, as well as an NRC-approved '

surety, before an award could be made. NRC participants indicated that the short turnaround made it impracticable for NRC staff to review the necessary documentation and issue the required license amendments.  !

R. Shaffer indicated that the State could delay, if it were absolutely required to get the necessary paperwork done to qualify bidders.

Participants indicated that we would wait and see how many bids were submitted by the June 30, 1987 deadline, before considering changing the schedule. J R.
