l APPLICANTS' MOTION TO STRIKE NRC STAFF'S RESPONSES TO MOTIONS FOR RECONSIDERATION FILED BY THE TOWN OF AMESBURY AND THE TOWN OF HAMPTON I
on May_18, 1987, this Licensing Board issued a Memorandum and order setting forth the basis of its Decision of February 18, 1987, ruling on the admissibility of contentions addressing Revision 2 of the New Hampshire i
Radiological Emergency Response-Plan.
This Memorandum and Order was in the nature of a prehearing conference order, l
admitting or denying contentions and, therefore, procedures i

with respect thereto are governed by 10 CFR $ 2.752.2' That section provides that " objections to the order may be filed by a party within 5 days after service of the order."
10 CFR $ 2.752(c).
Of more moment to this motion, the regulation further provides:
" parties may not file replies to the objections unless the Board so directs."
By captioning their objections to this order as motions for reconsideration the Towns of Amesbury and Hampton cannot turn what amount to objections to a prehearing order into something else.
In addition, the Staff, having not objected to the order within the 10 days allowed, should not be permitted, by-filing a supererogoratory response to a miscaptioned document to make a late objection to the prehearing conference order.
In reliance-on the Rules of Procedure, the Applicants have not replied to the two motions for reconsideration because no reply is allowed absent the Licensing Board directing such a reply.
The prejudice to the Applicants is obvious.
WHEREFORE, the Applicants move that the Staff's responses to motions for reconsideration filed by the Town 1
It would seem that each of the intervenors who filed these motions (SAPL, TOH and Amesbury). fully realized-that 10 CFR $ 2.752 governed, because all filed their
" motions" within the time period allowed by 10 CFR
$ 2.752(c) (5 days plus 5 days because service was made by mail).
