NOTICE OF VIOLATION Commonwealth Edison Company Docket No. 50-455 As a result of the inspection conducted on September 13 - October 15, 1986, and in accordance with.the " General Policy and Procedures for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1986), the following violation was identified:

ANSI N45.2.3-1973, " Housekeeping During the Construction Phase of Nuclear Power Plants," is endorsed by Regulatory Guide 1.39, Revision 2. Regulatory Guide 1.39, Revision 2 . Regulatory Guide 1.39, Revision 2 is committed to in Appendix A of the Byron FSAR.

ANSI N45.2.3-1973, Section 1.1 requires that housekeeping encompasses all activities related to control of cleanliness of facilities, cleanliness of material and equipment, fire prevention and fire protection including disposal of combustible materials and debris. Section 3.3 requires that the receiving, storage, and handling activities required by this standard shall be performed as specified in ANSI N45.2.2-1972.

ANSI N45.2.2-1972, " Packaging, Shipping, Receiving, Storage, and Handling of Items for Nuclear Power Plants (During the Construction Phase)," Section 6.2.3 requires that fire protection commensurate with the type of storage area and the material involved shall be provided and maintained. Section 6.3.3 requires that hazardous chemicals, paints, solvents, and other material of a like nature shall be stored in well ventilated areas which are not in close proximity to important nuclear plant items.

Contrary to the above, on October 1, 1986 in the Unit 2 lower cable spreading room at the 439 foot level the following items were discovered:

a. A one pound coffee can about half full of acetone sitting uncontrolled and unattended in a non-approved container on a ventilation duct.
b. A one quart paint-type can of contractor adhesive lying uncontrolled and inadequately sealed in a safety-related cable tray.

This is a Severity Level IV violation (Supplement II). (455/86031-02(DRP))

l Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
