Dear Mr. Arthur:

This letter responds in part to your March 20, 1987 request for consents regarding draft documents concerning the Riverton Remedial action. I am corvnenting on the documents separately to expedite NRC's response to D0E.

This letter addresses the draf t M-K Ferguson Prequalification Requirements.

The NRC's conrnents are:

1. The document should indicate what criteria are to be used to determine accomplishment of milestones for performance, either by reference or r explicitly: for example, removal of contaminated material frem the

{

processing site shuuld comply with cleanup requirements of 40 CFR Part 192 i Subpart B.

2. All of the three documents identify a September 1992 milestone for remedial action completion at the site of consningling. We consider the prequalification document to be the most appropriate document to effectively address this goal.
3. This document should also require the subcontractor to legally identify and describe the parcel of land to be used during disposal operations, as well as the final parcel of land to be transferred to DOE upon completion of remedial action.

NRC staff will transmit comments on the proposed Congressional Notification and the proposed Cooperative Agreement nodification as soon as possible.
