PROPOSED IMPOSITION OF CIVIL PENALTIES - $375,000 EN 86-53, dated July 3,1986, was issued to inform the Comission that a Notice of Violati n and Proposed Imposition of Civil Penalties in the amount of One Hundred Seventy-five Thousand Dollars ($175,000) was to be issued to Sacramento Municipal District. This action was Dased on violations identified as a result of the " Loss of DC power to the Integrated Control System (ICS)

Event" which occurred on December 26, 1985 at the Rancho Seco facility. At Commissioner Asselstine's request, a hold was placed on the proposed enforcement action and a revised enforcement action to address Commissioner Asselstine's concerns was forwarded to the Comission on September 26, 1986 (SECY 86-286).

The Commission evaluated the revised proposed enforcement action, and directed the staff in a memorandum from the Secretary, dated October 15, 1986 to proceed with the issuance of the Notice. Therefore, a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of Three Hundred Seventy-five Thousand

($375,000) will be 1: sued October 22, 1986 to Sacramento Municipal Utility District.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

Mailing of Notice October 22, 1986 Telephone Notification of Licensee October 22, 1986 A news release has been prepared and will be issued after the licensee receives the Notice. The State of California will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
