Dear fir. Baublitz:

I am writing to you regarding the question of standards for stabilization of residual radioactive material, such as the Riverton material, at NRC-licensed uranium mills.

It is our opinion that complying with EPA standards applicable to NRC licensees (40 CFR Part 192 Subparts D and E) and NRC regulations (10 CFR Part 40 Appendix A), implemented through an NRC-approved final reclamation plan, will also satisfy the stabilizaticn, control and radon attenuation standards for remedial actions at inactive sites (40 CFR Part 192 Subpart A).

We base our opinion on the essential identity of the two sets of closure standards.

Ground-water protection at commingled disposal sites should be conducted according to NRC regulations and EPA active site standards (40 CFR Part 192 Subparts D and E), since ground-water protection would most likely relate to conditions existing prior to commingling. However, if final EPA inactive site standards relating to ground-water protection impose more stringent requirements for residual radioactive materials, remedial actions involving such commingling may need to be revisited.
