Dear Mr. Thorne:

The enactment of Section 603 of the Anti-Terrorism Act of 1986 has resulted in the need to reach agreement on the appropriate means for fulfilling the Defense Department's consultation requirements with respect to the physical security aspects of nuclear exports and retransfers. It has been NRC's view that this. consultation can most effectively be carried out utilizing the existing interagency procedures.

'As you are aware D00 has forwarded to NRC and DOE a list of questions they have posed with respect to two pending NRC HEU export requests and one DOE retransfer request. Although D0D has not followed the formal interagency.

procedures for addressing these questions. I understand that active efforts are underway within the Executive Branch to respond to D0D's questions.

I would like to assure you that the NRC s'taff, using the existing procedural framework, is prepared to provide prompt assistance to you in this effort in order to facilitate the preparation of the Executive Branch's views on the pending NRC export license applications.

As a related matter, we continue to be prepared to meet with the interested Executive Branch agencies, as we have notified D00, to resolve promptly any issues which remain that affect the fulfillment of D0D's consultation requirements.
