FINAL RULE - REGIONAL NUCLEAR MATERIALS LICENSING FOR THE UNITED STATES AIR FORCE Enclosed is the final rule package to transfer licensing authority for the U.S.

Air Force " master" materials license from Headquarters to Region IV.

Previously, we decentralized the bulk of the materials licensing program through similar actions in 1983, 1984, and 1985. The 1985 rule package included a state-ment which announced our intention to decentralize the Air Force license after their 70 or so licenses were consolidated. That consolidation is now complete, and Headquarters staff is confident that Region IV will encounter no special problems because of the consolidation. This action executes a policy decision approved and announced by the ED0 in the previous rulemakings.

We circulated an earlier draft of the final rule package to the Division of l Rules and Records, and received their response dated August 18, 1986 (enclosed '

as background). It directed us to submit our package to the RES rulemaking review group (RIRG). I discussed this requirement with Tom Rehm. He thinks that RIRG review would not be necessary, nor would.a regulatory analysis be l required since this is such a minor procedural issue. (It is really little l more than a change of mailing address affecting only one licensee.) The backfit rule does not apply to material licensing issues. We have decentralized about 8,000 other licenses without involving the RES staff. We believe the ,

action would not require an independent review because the ED0 had already  !

approved this action in the 1985 rulemaking (ref: 50 FR 14692 and the Daily Staff Notes). Therefore, I have prepared a memorandum for your signature to the ED0 clearly explaining the course we have followed.

If, however, we are directed to follow the instructions in the Division of Rules and Records memorandum, we expect a slip of many months could result.

We would have to adjust our proposed effective date for the address change ,

from October 1, 1986. j i

I request that you sign the memorandum to the EDO recommending his approval, the '

congressional letters, and the Delegation of Authority.
