AFPLICANTS' PESPONSE TO SAPL's MOTION FOR RECONSIDERATION OF DECEMEER 4, 1986 MEMORANDUM AND ORDER ESTABLISHING HEARING SCHEDULE ON OFFSITE ISSUES PAISED BY NHRERP Under date of December 12, 1986, SAPL has filed a motion for reconsideration of the scheduling order handed down 4
by thi s Board on December 4, 1986.
Three complaints are made.
The first complaint is that the schedule will require SAPL's coupeel to work over the holidays in order to meet tFe y<
filing deddline imposed for answering to the positions taken by the Applicants and Staff on contentions.
Applicants have no objection to the Board allowing some e.<tra time for this filing in order to avoid impinging on counsel's holiday plans.
The second complaint is the lack of a prehearing h50Ok43 O

conference to provide an oppcrtunity fer oral argument with respe:t to the proffered contentiens.
.lbers is no -ight tc su:h 'an argument and therefore there is no requirement that there be a prehearing con 4erence.
All that is'necessary'is that-the of4erer'of the contention be given an oppcrtunity to be heard; provision for a written reply fully satisfies that rule.
See Houston Lightzng & Power Co.
(Allens Creek Nuclear Generating 5tation), ALAB-565, 10 NRC 521, 525 (1979).
The thirc conpl aint is the shortness of the contemplated discovery pericd. 'There is no reason for further lengthy discovery on tne New Hampshire Plans.
The Beard should adhere to the pcsition it has taken on this matter.
CONCLUSION Except to the extent of accommcdating ccunsel with respect to the holidays, the motion snould be denied.
Respectfully submitted, fM
