HAMPTON OBJECTION AND MOTION FOR i

RECONSIDERATION OF HEARING SCHEDULE l

Under date of December 12, 1986, Town of Hampten (TCH) has filed a motion for reconsideration of the scheduling order entered by this Board on December 4,

1986.

The complaints set l

forth therein parallel those of other intervenors and have been addressed in Applicant's resconses to those similar motions. - [fkI g.. -

i l

The only legal argument made in the motion is the l

assertson that TOH is entitled as o* right to have a prehearing conference to present oral argument on the contentions.

This is not the law.

The balance of the motion complains generally of the tightness of the schedule.

Presumably, this has already neen considered by'the Board in setting the original schedule and no good reason is given for revisiting it now.

CONCLUSION The motion should be denied.

Resoectfully submitted, s
